Your letter of September 3,1970, to Mr. Robert D. O'Neill, has been referred to en for reply.

I am pleased to provide infor=ation con-cerning the Toledo Edison Co:pany's proposed Davis-Besse Nuclear Pouer Station.

As you requested,1 am encJosing a list of the members of the Advisory Cor=tittee on Reactor Safeguards (ACRS) who rendered the Davis-Besse report.

At the present time, a public hearing on the application of the Toledo Edison Co=pany for the Davis-Besse plant is not expected to be held before Novecher 1970. LTaen a Notice of Hearing is issued for the Davis-Besse plant, I will see that a copy of the Notice is forwarded to you. The Notice will be issued at least 30 days prior to the hearing, and will set forth the day, time, and place of the hearing, and the procedures by which a member of the public may participate in the hearing either as a party or by means of a limited The Notice also will set forth the members of the Ato ic appearance.

Safety and Licensing Board who will conduct the hearing.

Under the National Environmental Policy Act of 1969 (copy enclosed),

each Federal agency is required to consult with appropriate Federal, State, and local agencies concerning major Federal actions signifi-cantly affecting the quality of the human environment and to prepara a detailed statement concerning, among other things, the environnantal impact of the proposed action. Enclosed is a copy of the statement of general policy which indicates the canner in which the Atomic Energy Commission proposes to exercise its responsibilities under the Act.

This policy statement is based upon the Council on Environmental Quality's Interim Guidelines (copy enclosed), and uns published for public connent in the Federal Register on June 3,1970. As the policy statement indicates, the Comniscion has identified the licensing of nuclear power reactors as one of the actions which would require the preparation of an environnental statement.

Honorable Jackson E. Ectts I am enclosing a copy of the environmental report prepared by the Toledo Edison Company for the Davis-Besse plant. A copy of this report has been sent to the Governor of Ohio and the Council on Environmental Quality, and it has been made available for coment by appropriate Federal, State, and local agencies. Af ter the con-clusion of the comment period, the regulatory staff vill prepare a detailed environmental statement which will include a discussio t of any problems or objections raised and the disposition thereof.

Copics of the detailed environmental statement vill be forwarded to the Council on Environmental Quality and the agencies concerned, and vill accompany the application through the Comission's review process, including the public hearing.
