MOTION OF CITY OF CLEVELAND FOR THE ESTABLISHMENT OF PAGE LIMITATIONS FOR BRIEFS On January 19, 1977 this Appeal Board enlarged the time for filing and briefing exceptions in the above-entitled proceedings. By the same order, ruling on page limits for briefs in support of exceptions filed by parties other than applicants was reserved. Pursuant to the Appeal Board's order, the City of Cleveland (City) filed its Notice of Appeal and Exceptions on February 7,1977., Accordingly, City re-quests the Appeal Board to establish page limits for briefs relating to City's exceptions.

City has stated six specific exceptions to the decision of the Licensing Board. The subject matter of two of those exceptions--

fI i-f' 80 08 050 f Y/

2-numbers 4 and 5--have already been fully developed in briefs before the Appeal Board or are in the process of being argued in collateral proceedings. No extended briefing is required of those exceptions and indeed they are raised at this time by the City out of an abun-dance of caution to fully preserve its rights on appeal. While the remaining issues are important, it is not believed that extended briefing will be required to state City's position.

City suggests the following page limits for briefs relating to City's exceptions:

Briefs in support 30 pages Briefs opposed 30 pages Reply briefs 15 pages Wherefore City requests the Appeal Board to enter its order es-tab 11shing page limitations.

Respectfully submitted, Reuben Goldberg David C. Hjelmfelt Goldberg, Fieldman & Hjelinfelt, P. C.
