APPLICATION OF THE DEPARTMENT OF JUSTICE FOR A SUBPOENA TO THE PENNSYLVANIA ECONOMY LEAGUE Pursuant to Section 2.720 of the Commission's Rules of Practice (10 C.F.R. S2.720), the Department of Justice hereby requests the issuance of the attached subpoena to the Pennsylvania Economy League, Inc. (League) requiring the production of certain documentary evidence on or before June 29, 1976.

The League, with branches throughout Pennsylvania, is believed to be an incorporated nonprofit organization which has conducted studies for Pennsylvania municipe.lities. Such studies have allegedly been undertaken by the League's Western Division 0003 050 f3y n- - -

with respect to the municipal electric systems of certain Pennsylvania municipalites located within the retail service area of the Pennsylvania Power Company and the Duquesne Light Company.

The Department believes that a qu'estion of fact may e ist as to the impartiality of the League. Because Applicants have offered at least some of these studies as evidence in their direct case, it is necessary, for a complete examination of all the relevant facts, that the Department be afforded the opportunity to examine those documents bearing on the impartiality of the League or its Western Division.

For the foregoing reasons, the Department requests that the attached subpoena be issued.
