MOTION OF THE CITY OF CLEVELAND, OHIO FOR AN ENLARGEMENT OF TIME FOR FILING ITS BRIEF IN SUPPORT OF EXCEPTIONS On November 5,1976, the Special Board Established For 10 CFR

$2. 713 Proceeding (Special Board) issued its decision on remand granting the motion of Squire Sanders and Dempsy and dismissing the City of Cleve-land's (Cleveland) motion to disqualify Squire Sanders and Dempsy and its Washington a'ffilliate from participating as counsel for any of the applicants in the above-entitled matters. On November 12, 1976, Cleveland filed its

, Notice of Appeal and Exceptions to the Decision of the Special Board. Cleve-land moves for an enlargement of the time for filing its brief on exceptions until January 28, 1977. .

2 Cleveland has moved to disqualify the law firm of Squire Sanders and Dempsy and its Washington affiliate from acting as counsel for parties adverse to Cleveland in antitrust review proceedings held pursuant to Section 105c of the Atomic Energy Act. The record has now been closed in those proceedings and briefs have been filed. Squire Sanders and Dempsy participated in the hearings and in the preparation of briefs for The Cleveland Electric Illuminating Company.

During the pendency of thisi l roceeding, Cleveland filed a civil anti-trust complaint against The Cleveland Electric Illuminating Company (CEI) in the United States District Court for the Northern District of Ohio, Eastern Division. Subsequent to the commencement of the civil action Cleveland and CEI negotiated with respect to resolution of the litigation pending between them. As a result of those negotiations, the Mayor of Cleveland and the President of CEI executed a Memorandum of Understanding providing for the sale of Cleveland's municipal electric system to CEI. The saie is contin-gent upon certain events such as approval by the City Council of Cleveland.

The Memorandum of Understanding provides for clo. sing the sale on January 10, 1977.

Should the sale be effected, th<; litigation pending between Cleveland and CEI in the antitrust review pror.eeding and the disqualification proceeding would be moot. In that event it would be unnecessary for the Appeal Board to address the issues raised by Cleveland's exceptions to the decision of the i
