1. On January 12, 1973, the Atomic Safety and Licensing Appeal Board (" Appeal Board") issued an Order inviting all parties to this antitrust proceeding to file a supplemental brief of 30 pages discussing the applicability to this case of the Appeal Board's decision in Consumers Power Co. (Midland Plant, Units 1 and 2) , ALAS-452, 6 N.R.C. (December 30, 1977). The ticle within which to file has since been extended :c and i:':luding February 27, 1978. Pursuant to Section 2.730 of the Commission's Rules of Practice, 10 C.F.R. 5 2.730, Applicants hereby see2 leave of' the Appeal Board to file a brief 15 pages over the current page limit.

2. The 432-page opinion by the Consumers Appeal Board discusses a number of matters that bear both directly and indirectly on the antitrust analysis that is required in the present pro-ceeding. In some areas, there is, we believe, reason for this Appeal Board to follow the guidance in ALAB-452. In other areas, there are both factual and legal grounds for finding the Consumers decision inapposite to the situation that exists here. We have undertaken to set forth as crisply as possible our views con-cerning the similarities and dissimilarities between the two cases, and to suggest the extent to which ALAB-452 can properly be re-garded as having an impact on the present appeal. In spite of our efforts to hold this discussion to the 30-page limit, it is now evident that we simply cannot meet that requirement without eliminating entirely certain portions of our analysis of Consumers which we feel would be helpful to the antitrust deliberations being undertaken by this Appeal Board.

3. For obvious reasons, we would prefer not to do that.

Based on the draft we have now prepared and circulated among counsel for final revision and approval, we are confident that the points we wish to make can be briefly but adequately presented if the additional pages sought here are allowed. Accordingly, Applicants respectfully request permission to file a supplemental brief commenting on the applicability here of ALAB-452 which in-cludes 15 additional pages, or a total of 45 pages. We, of course,

. rm would understand that the opposing parties who desire to file supplemental briefs would similarly be. allowed ^45 pages.

WHEREFORE, Applicants respectfully request that their  !

motion to file a supplemental brief containing no more than j forty-five pages on or before February 27, 1978, be granted.

1 The undersigned counsel has been advised by counsel for the Department of Justice, the Staff of the Nuclear Regulatory Com-mission and the City of Cleveland that they do not oppose this request. However, Staff has asked us to indicate to the Appeal Board that the 30-page limit will be adequate for its purposes and it intends to comply with the original page limit.
