MINUTES OF CONFERENCE CALL OF JULY 19, 1976 A conference call was held at approximately 3 p.m. on July 19, 1976.
Participating in the call were Chairman Rigler and Messers Lessy, Charno, Reynolds and Hjelmfelt.
Mr. Lessy stated that the purpose of the conference call was to discuss rebuttal evidence to the Milburn depositior. Mr. Leesy noted that the Board had left the record open to presentation of rebuttal testimony in the form of an affidavit, but that Mr. Reynolds had objected, requesting the right to cross-examine on any rebuttal testimony. At the time Mr. Lessy informed Mr.
Reynolds that Mr. Hart-would probably be the rebuttal witness. Mr. Lessy had learned today that Mr. Hart will be in Washington, D. C. on July 20, 1976 in connection with the reopening of the record with respect to the Gaul tapes.

4 Mr. Lessy would like to call Mr. Hart as a witness on July 20 to rebut the Milburn deposition and so informed Mr. Reynolds at 2 p.m. on July 19, 1976.
Mr. Reynolds objected necessitating this conference call.
Chairman Rigler asked when Mr. Reynolds had been informed of the identity of the proposed witness. Mr. Lessy said two weeks ago.
Mr. Reynolds stated that he had two problems with Mr. Hart testifying on July 20, 1976. First, he objected to Mr. Hart testifying on the Gaul tapes as stated in his earlier objection to reopening the record.
Mr. Lessy then stated that Mr. Hart was not en11ed to testify with respect to the Gaul tapes.
Mr. Reynolds then stated that he objected to Mr. Hart's proposed testimony because Mr. Hart had appeared as counsel for one of the parties during the Milburn deposition.
Mr. Rigler stated that he had no problem with Mr. Hart testifying and noted that Mr. Hart had previously appeared as a witness. He also stated that he did not feel that additional preparation time was required.
Mr. Reynolds stated that he had a problem in that he had just been notified of Mr. Hart's proposed appearance at 2 p.m. on July 19, 1976.
Mr. Rigler noted the limited nature of the proposed testimony and that at this stage of the proceeding the parties could not expect lengthy time for preparation and that he found no prejudice in permitting Mr. Hart to testify nor reason for delay.
