APPLICANTS' MOTION TO COMPEL DISCOVERY FROM AMP-OHIO

1. On October 22, 1974, American Municipal Power-Ohio, Inc. (" AMP-Ohio") requested that the time within which to respond to Applicants' interrogatories be extended to November 20, 1974 In making this request, AMP-Ohio represented that a number of its responses "will be completed and available for filing no later than October 31, 1974,"

but that the requested "short delay" was needed to complete the " extensive coordination" of responses by the 44 member systems of AMP-Ohio. The Applicants (joined by the City of Cleveland, with no objection from the Department of Justice or the Regulatory Staff) also requected that the time for responding to interrogatories be changed; they sought a longer extension than AMP-Ohio indicated it needed -- until November 30, 1974

~2. By Order of the Licensing Board dated November 4, 1974, the hearing schedule was modified in accordance with Applicants' request to permit an additional 30 days for responding to written interrogatories and document re-quests. On December 2, 1974 (November 30 was a Saturday),

all parties to this proceeding except AMP-Ohio exchanged their written answers in compliance with the Bcard's Novem-ber 4 Order.

3 . Applicants have not yet received an" responses or documents from AMP-Ohio, notwithstanding AMP-Ohio's rep-resentation to this Board on October 22, 1974, that it would be in a position to provide to Applicants a part of the in-formation requested as early as October 31, 1974, and could furnish the remainder of the information requested by November 20, 1974. Accordingly, Applicants hereby move pursuant to 10 CFR Section 2.740(f) for an order compelling AMP-Chio to respond to Applicants' written interrogatories and to pro-duce the documents requested.
