SUPPLEMENT TO APPLICANTS' BRIEF OF SEPTEMBER 12, 1975 In reviewing " Applicants' Brief In Response To The '
August 14, 1975 Order of The Appeal Board", filed-on September 12, 1975, the undersigned counsel discovered a misstatement he made therein, which, while having no material impact on the argument presented by Applicants, should, in fairness to the Appeal Beard and all parties, be promptly corrected so as to remove any possible misunderstanding. The misstatement appears on page 19 of Applicants' Brief in conn.ection with the comment about the review standard used by the Court of Appeals in De Costa Columbia Broadcasting System, Inc. F. 2d No. 73-1391 (1st Cir., June 24, 1975)

The "manfest error" test referred in Applicants' Brief was the standard applied by the United States District Court in De Costa (No. 73-1391, supra, slip op. 3). The Court of Appeals, after examining the consensual reference of trial issues to a Special Master, concluded that limited review of the Master's decision should be available under a less stringent standard that that applied below. It held (No. 73-1391, supra, slip op. 14-15):
We must, therefore, treat the district court's failure to review the magistrate's decision on the law under Rule 53 as error.
It may well be noted-that, deciding that a different standard of review should be applied, logic should compel us to remand to the district court. But we would have to repeat the legal review and we see no favor to the parties in prolonging further these aging proceedings. ;
We proceed, then, treating the factual findings of the magistrate adopted by the district court as subject to the clearly erroneous standard of Rule 52 (a), and treating the legal decision .
of the magistrate as subject to the full review l of this court. j Unlike the present appeal, De Costa did not involve a request for interlocutory appellate review. There l are, moreover, other important distinguishing factors discussed in Applicants' Brief which suggest that the Court of Appeals' decision there has only limited application to the present inquiry. Even so, the holding of the Court of Appeals should be accurately described.
