s STATEMENT ON PARTICIPATION BY THE STATE OF OHIO 1.

In its Notice and Order for Prehearing Conference filed on May 31, 1974, the Atomic Safety and Licensing Board ordered a special prehearing conference to be held in the above-captioned matter on-June 14, 1974.

The subject of this prehearing confer-ence was to be:

" (1) issues in controversy; (2) scope and ex-tent of discovery; (3) consolidation matters; (4) schedule for this proceeding; and (5). such other matters as may aid in this proceeding."

In a subsequent Notice and Order Rescheduling Pre-

' hearing Conference filed on June 10, 1974, the special prehear-ing conference was rescheduled to occur on June 25, 1974.

The State.of Ohio, a participant in this proceeding under 8002200 /p g

10 C.F.R. 5 2. 715 (c), Rules of Practice, proposes to exercise its right of participation in the following manner:

(1)

The State has chosen not to participate in the formation of issues in controversy; rather it will abide by the ultimate decision of the Board as to such issues; (2)

The State has chosen not to conduct discovery or introduce evidence in this proceeding; (3)

The State does choose to preserve for itself a a

reasonable opportunity:

(a) to make brief opening and closing state-ments; (b) to conduct supplemental interrogation of witnesses, on all issue,s in controversy, with sequence of interrogation by the par-ties and the State to be discussed in future conferences among the parties and the State; and

.(c) to submit proposed findings of fact, conclusions of law, and relief on all issues.in controversy.

After conferences involving counsel for Applicants, the City of Cleveland, the Regulatory Staff, the Department of Justice,

the nature and scope of participation by the State of Ohio in this proceeding as set'forth hereinabove.
