50-441A MOTION OF THE CITY OF CLEVELAGU TO QUASH OR MODIFY APPLICANTS' SUBPOENAS AND MOTION TO DEFER THE TAKING OF DEPOSITIONS The City of Cleveland (Cleveland) pursuant to Section 2. 720(f) of the Commission's Rules of Practice hereby nioves to quash or modify ApplicanM' subpoenas. In addition, Cleveland,, arsuant to Section 2. 730 of the Com-mission's Rules of Practice, moves to defer the t.' king of depositions.

The difficulties encountered by the parties to this proceeding to obtain access to, inspect, and study the documents produced by Applicants have beea well described in pleadings previously filed with this Board. '

Despite these difficulties, Clevsland is cont;nuing its efforts to expeditiously examine the mass of materials produced by the Applicants in response to the City's Request For The Production Of a cuments. In this regard the 8 0 02 200 96g A V

. City has assigned additional counsel to the case who will be in Cleveland the entire week of December 16-20 and every day but Christmas during the week of December 23-27. Counsel is prepared to devote such additional time as may be required. However, despite such efforts it is now apparent that Cleveland will be unable to complete its review of the documents pro-

duced by Applicants prior to the commencement of depositions.

- Not only will commencement of depositions on January 6,1975, as noticed by Applicants, be unfair to the parties who, like Cleveland, will have been unable to complete a review of Applicants' documents, but it will necessitate an interrutpion of the inspection of those documents during the period in which counsel is required to attend depositions. An orderly processing of discovery in this case requires that all the parties be accorded sufficient time to review the documentary evidence prior to the commence-ment of the taking of depositions.

To continue to expedite the discovery stage of these proceedings Cleveland seeks only the minimum extension of time in which to complete its review of documents. Accordingly, Cleveland requests that the B ard make corresponding adjustments in all other dates as necessary.

WHEREFORE, Cleveland prays that the Board will quash or modify the Applicants' subpecnas and to defer the taking of depositions until the parties have had sufficient time to review the documents produced by Applicants.
