MOTION FOR EXTENSION OF TIME 1.

By Memorandum and Order dated August 12, 1974, the Licensing Board amended the Hearing Schedule set forth j

l in Prehearing Conference Order No. 2 to require the completion of all documentary discovery and responses to interrogatories by October 31, 1974.

Applicants hereby move for a 30-day extension of time, until November 30, 1974, wichin which to produce documents and answer interrogatories.

It is further requested that the remaining dates in the Hearing Schedule be adjusted to reflect a similar extension.

2.

This motion for more time is necessary to provide Applicants a reasonable opportunity to inspect all relevant files since September 1, 1965 -- which is alone a monumental task -- and remove therefrom the various documents which nust 80 0 2180 gg-

. be produced.

Applicants did not receive the Licensing Board's October 11 " Order On Objections To Interrogatories And Docu-ment Requests" until Oct'ober 15, 1974 At that particular time, counsel for Applicants were totally preoccupied with other matters, including the preparation of an extensive Reply Memorandum relating to Applicants' Motion for Summary Dispo-sition, which was filed with the Licensing Board on October 21, 1974.

Accordingly, Applicants' counsel are only now in a po-sition to begin coordinating the time-consuming file searches that must be undertaken in compliance with the documentary discovery requests.

From a preliminary examination of the volume of material involved, the additional 30 days are abso-lutely essential to permit the Applicants to make the thorough file inspection required by the Licensing Scard's Order in order to assure a proper and complete document production.

3.

Counsel for the City of Cleveland has authorized Applicants' undersigned counsel to state that the City joins in this request for more time.

Both the Department of Justice and the AEC Regulatory Staff have advised that they do not oppose the motion.

Respectfully submitted, SHAW, PITTMAN, POTTS & TROW 3 RIDGE By 9._. -N.. N _.. A
