APPLICANTS' RESERVATION OF RIGHT TO APPEAL LICENSING BOARD GRANT OF CITY OF CLEVELAND'S PETITION TO INTERVENE 1.
In its Memorandum and Order dated March 15, 1974, the Licensing Board conditionally granted the petitions of the City of Cleveland in the above captioned proceedings finding that the Petitioner's showing of nexus was only
" marginally adequate."
The Licensing Board directed the Petitioner, within twenty days, to clarify its position on nexus to conform with the Commission's Memorandum and Order of February 23, 1973, In the Matter of Louisiana Power and Light Company (Waterford Unit 3), Docket No. 50-382A, RAI-73-2-48, and its Memorandum and Order of September 28, 1973, In the Matter of Louisiana Power & Light Company (Waterford Unit 3), Docket No. 50-382A, RAI-73-9-619.

Section 2.714a permits an appeal at this junc-ture in the proceedings only from the basic grant or denial of a petition for leave to intervene.
While Applicants assert that Petitioner did not adequately meet the Waterford nexus requirement in its pleadings and in its amplification of the pleadings at the two Prehearing Conferences, Appli-cants' understand the Licensing Board's Order of March 15, 1974, as only conditionally granting the petitions at this time. /

Accordingly, Applicants request leave to reserve their right to appeal any unconditional grant of the petitions following the Licensing Board's decision which may be taken following the Petitioner's filing of the clarifica-l tion of its position on nexus as ordered by the Licensing i

In the March 15, 1974, Order, the Licensing Board expressly reserved any ruling on the petition for j
leave to intervene filed by American Municipal Power - Ohio
(" AMP-O") in the Perry proceeding until a further filing is made by that Petitioner.
Therefore no reservation is necessary at this time by Applicants with-respect to the AMP-O petition.
