TO II TEP!E':E OF TT_ CITY OF CL EVELAND, O!J10 On July 27, 1971, the City of Cleveland, Ohio, (Petitioner) filed an "h.endment to Petition to Intervene" in which it presentco information to supplement its reques t of July 6,1971, tha t the Atomic Energy Cont.iission (Cone:iission) hold a hearing on the antitrust con-siderations of the application for a construction permit in the cap-tioned r:atter. Tha omended petition asserts that there has been an Opparent change in re.terial facts bearing upon the matter.
In cnswering Petitioner's earlier request, the AEC regulatory staff not.ed thct the Attornoy Gener;l had foncrded his advice to the Com-mission cor.r.Orning the antitrust considerations relating to the appli-Cdlion, and that this advice Would be published in thG feC2Tal Register, pursuant to 10 CFR 52. iD2 of the Cc.::nission's " Rules of Practice."
