NUCLEAR REGUIA'IOE CCit1ISSION ADVISORY COSDiITTEE ON REACIOR SAFEGU.GCS SUBCONTIEE ON THE D,WIS-BESSE NUCLEAR PCGER STATION, UNIT 1 Notice of Meeting In accordance with the purposes of Sections 29 and 182b. of the Atomic Energy Act (42 U.S.C. 2039, 2232 b.), the ACRS Subcommittee on the Davis-Besse Nuclear Power Station, Unit No.1, will hold a meeting on December 21, 1976 in Room 1146, 1717 H Street, N. W., Washington, DC 20555. The purpose of this meeting is to review the application of the Toledo Edison Company and the Cleveland Electric Illumi.,ating Company for a license to operate Unit 1.
The agenda for subject meeting shall be as follcws:

i will meet in open Executive Session to explore their preliminary 1
opinions, based upon their independent review of safety reports, i
regarding matters which should be considered during the open session in order to formulate a Subcommittee report and recorrendations to the full Committee.
9:00 a.m. until the conclusion of business.
The Subcommittee will treet in open session to hear presentations by representatives of the NRC Staff, the Toledo Edison Company, the Cleveland Electric Illuminating Company, and their consultants, and l
will hold discussions with these groups pertinent to this review.

- At the conclusion of the open session, the Subco=nittee may caucus in a brief, closed session to determine whether matters have been adequately l
covered and whether the project is ready for review by the full l
Committee. During the session Subcornittee members and consultants will discuss their final opinions and recommendations on these i
I matters. Upon conclusion of this caucus, the Subcom:nittee will meet again in brief open session to announce its determination.
In addition to the closed deliberative session, it may be l
necessary for the Subcomnittee to hold one or more closed sessions I
for the purpose of exploring with the NRC Staff and Applicant matters involving proprietary information, particularly with regard to specific features of the plant design and plans related to plant security.
j I have determined, in accordance with Subsection 10(d) of Public Law 92-463, that it is necessary to conduct the above closed sessions to protect t
the free interchange of internal views in the final stages of the Subcosnit-tee's deliberative process (5 U.S.C. 552(b) (5)) and to protect confidential proprietary information (5 U.S.C. 552(b) (4)). Separation of factual material from individuals' advice, opinions, and recommendations while closed Execu-I tive Sessions are in progress is considered impractical.

3 Practical considerations may dictate alterations in the above agenda or schedule. The Chairman of the Subcommittee is empowered to conduct l
the meeting in a manner that, in his judgment, will facilitate the orderly a
conduct of business, including provisions to carry over an incompleted open session from one day to the next.
With respect to public participation in the open portion of the meeting, the following requirements shall apply:

The Committee will receive oral stocements on topics relevant to tne Com-mittee's purview at an appropriate time chosen by the Chairman of the 1
Subcommittee.

Persons with agreements or orders permitting access to proprietary information may attend portions of ACPS meetings where this material is being discussed upon confirmation that such agreements are effective and relate to the material being discussed.
The Executive Director of the ACPS should be informed of such an agreement at least three working days prior to the meeting so that the agreement can be confirmed and a determination can be made regarding the applicability of the agreement to the material that will be discussed during the meeting. Minimum information providod should include information regarding the date of the agreement, the scope of material included in the agreement, the project or projects involved, and the names and titles of the persons signing the agreement.
Additic tl information may be requested to identify the specific agree-i ment involved. A copy of the executed agreement should be provided to Mr. R. L. Wright, Jr. of the ACES Office, prior to the beginning of the meeting.
