ORDER August 25, 1975 The NRC staff and the Department of Justice have filed a " joint recuest" which, ir essence, seeks an extension of briefing time tc September 18, 1975.

We had previously issued a memorandum indicating that cral argument, if nec-essary, would be held on Tuesday, September 16, 1975.

A grant of the full extension of time'recuested would recuire postponement of the argument and, in view cf certcin scheduling difficulties, would lead to undue delay in reaching a deter-mination concerning the City of Cleveland's right to addi-tional discovery.

s 2-or orderly continuation of the trial on the merits, which is now scheduled to begin on October 30, 1975.

Accordingly, it is hereby ORDERED that all parties' time for filing briefs in response to the City's brief is extended to Friday, September 12, 1975; and it is FURTHER ORDERED that counsel filing such briefs insure that copies are in the hands of other ccunsel and this Board no later than the close of business on the filing date; and it is FURTHER ORDERED that oral argument will be heard by this Board at 1:00 p.m. on Tuesday, Sectember 16, 1975, in the Commission's Public Hearing Room on the 5th floor of the East West Towers Building, 4350 East West Highway, Bethesda, Maryland.
