l In accordance with the purposes of Sections 29 and 1826. of the Atomic i
l Energy Act (42 U.S.C. 2039, 2232 b.), the ACRS Subcomittee on the Davis-Besse Nuclear Power Station, Unit No.1, will hold a meeting on December 21, i
i 1976 in Room 1146, 1717 H Street, N. W., Washington, DC 20555. The purpose of this meeting is to review the application of the Toledo Edison Ccmpany and the Cleveland Electric Illuminating Company for a license to operate Unit 1.
The agenda for subject meeting shall be as follcws:

8:30 a.m. - 9.00 a.m.

will miet in open Executive Session to explore their preliminary j
opinions, based upon their independent review of safety reports, i
l regarding matters which shculd be considered during the open session in order to formulate a Subcomittee retort and recomendations to i
the full Conraittee.
9:00 a.m. until the conclusion of business.
The Subeccittee will meet in open session to hear presentations l
.by representatives of the NRC' Staff, the Toledo Edison Company, the i
Cleveland Electric Illuminating Company, and their consultants, and f
will hold discussions with these groups pertinent to this review.

At the conclusion of the ocen session, the Subec=mittee may caucus in a brief, closed session to determine whether matters have been adequately covered ar.d whether the project ic ready for review by the full Committee. During the session Subcccmittee members and censultants will discuss their final opinions and recommendaticas en these matters. Upon conclusion of this caucus, the Subcccmittee will meet again in brief cpen session to announce its determination.
In addition to the closed deliberative session, it may be necessary for the Subcocmittee to hold one or more closed c.essions for the purpose of exploring with Se !GC Staff and Applicant matters involving proprietary information, particularly with regard to cpecific features of the plant design and plans related to plant security.
I have determined, in accordance with Subsection 10(d) of Public Law 92-463, that it is necessary to conduct the above closed sessions to protect the free interchange of internal views in the final stages of the Subcommit-tee's deliberative process (5 U.S.C. 552(b) (5)) and to protect confidential proprietary information (5 U.S.C. 552(b) (4)). Separation of factual material from individuals' advice, opinions, and recocmendations while closed Execu-tive Sessions are in progress is considered impraccical.
. Practical consideraticns may dictate alterations in the acove agenda or schedule. The Chairman of the Subccamittee is e pcwered to conduct the meeting in a manner that, in his judg.ent, will facilitate the orderly conduct of business, including provisions to carry over an incompleted open session frca one day to the next.
With respect to public participation in the open pcrtion of the meeting, the following requirements shall apply:
(a)
Persons wishing to submit written state ents regarding the agenda may do so by providing a readily reprcducible copy to the Subec=ittee at the beginning of the meeting. Coments should be limited to safety related areas within the Committee's purview.
Persons desiring to mil written co=,ents may do so by sending a readily reproducible ccpy thereof in time for consideration at this meeting. Cc:ments postmarked no later than December 14, 1976, to Mr. R. L. Wright, Jr., ACRS, URC, Washington, DC 20555, will normally be received in time to be considered at this meeting.
Background information concerning items to be censidered at this meeting can be found in documents on file and available for public inspection at the NRC Public Document Room,1717 H St., N.W., Washington, DC 20555 and at the Ida Rupp Public Library, 310 Madison Street, Port C.linton, Chio 43452.
(b)
Those persons wishing to take an oral statement at the meeting should make a written request to do so, identifying the topics and desired presentation time so that appropriate arrangements can be made. The Committee will receive oral statements en topics relevant to the Com-mittee's purview at an appropriate time chosen by the Chairman of the Subco mittee.
(c)
Further information regarding tcpics to be discussed, whether the meeting has been cancelled or rescheduled, the Chairman's ruling on re-quests for the opportunity to present oral statements and the tire allotted therefor can be obtained by a prepaid telephone call on Dece-ber 20, 1976 to the Office of the Executive Director of the Cc=aittee (telephcne 202/634-1919, Attn: Pz. between 8:15 a.m. and 5:00 p.m., EST.

(e)
The use of still, motion picture, and television cameras, the physical installation and presence of which will not interfere with the conduct of the meeting, will be permitted both before and after the meeting and during any recess. The use of such equi;nent will not, hcwever, be allesed while the meeting is in sessica.

Persons with agreements or orders permitting access to proprietary infor:ation may attend portions of ACRS meetings where this material is being discussed upon confirmation that such agreements are effective and relate to the raterial being discussed.
The Executive Directcr of the ACRS should be informed of such an agreement at least three working days prior to the meeting so that tne agree ent can be confirred and a derermination can be rade regarding the applicability of the agreement to the material that will be discussed during the ceeting. Min =um infor:ratica provided should include information regarding the date of the agree ent, the scope of material included in the agreement, the project or projects involved, and the names and titles of the pe.;ons signing the agreement.
Additional information may be requested to identify the specific agree-ment involved. A copy of the executed agreement should be provided to Mr. R. L. Wright, Jr. of tne ACPS Office, prior to the beginning of the meeting.
(g)
A copy of the transcript of the open portien of the meeting will be available for inspection on or after December 30,1976 at the ::P.C Public Document Room,171'/ H St., N. W., Washington, DC 2055f, and at the Ida Rupp Public Library, 310 Madison Street, Port Clinten, Ohio 43-52.
