NOTICE OF APPEAL AND EXCEPTIONS l

In accordance with Sections 2. 730, 2. 762 and 2. 785 of the Commis-sion's Rule s of Practice and Procedure, the City of Cleveland (Cleveland) appeals from the Report of Special Master of June 19, 1975; the Special Master's Order on Reconsideration;1I and the Board's Order of July 21, 1975 denying Cleveland's Motion for Ce'rtification. Cleveland makes the following statement of exceptions:

1. The Atomic Safety and Licensing Board erred in denying Cleve-land's Metion for Certification of Special Master's Decision on Claims of Privilege.

2. The Atomic Safety and Licensing Board erred in finding that the decision of the Special hiaster was final and unreviewable.

3. The Special biaster erred in finding documents privileged and not subject to discovery on grounds other than those asserted by the party claiming privilea.

4. The Special hiaster erred in basing findings of privilege on inferences and not on facts of record.

5. The Special Staster erred in sustaining claims of privilege for documents even though the party claiming the privilege was unable to prove the identity of the author, the recipient, the distributees or the addressees.
