1 Files OPERATING LICIESE 7EE - DAVIS BISSE 1 On April 7,1977, Buclear Reseter Regulation (NRR) informed the License Fee Management Branch (LPMB) that they plassed to inaue an operating license approv4== rely April 15, 1977 for fuel loading only (0% power level) to Toledo Edison Coupesy (TEC) for the subject unit. TEC was billed $250,000 for the fuel loading license on April 13,1977 (Insoice 167-77). Subsequent u si y " m from NRR dated April 15, 1977 to LFMB stated that EER expected to issue a full power operating license t!!> TEC around April 18, 1977 and that LFMB should take the appropriate eteps to colleet the higher operating licensa fee. Da April 19, 1977, Invoice 167-77 was amended to provide for operation at 100% power and TEC paid the full fee of $762,820 on the same day.

The sequence to power operation would begin with Operational Mode 6 (initial fuel loading) and proceed in succession to Operational Mode 1 (power operation); however, certain items would have to be completed by the utility and would require the written approval of the Co-imaios prior to proceeding from one operational mode to another. Essentially them, License NPF-3, as issued on April 22, 1977, was a "0" power licanos since TEC ewuld not proceed to power opera-tion withmet written sotheriaation of the Commission.

- On June 21, 1977 I spoke to Mr. Lowell Rowe, Vice President, Facilities Developeset, Toledo Edison Company (419-259-5435 site), ec a erning the status of the resetor and the matter of a partial refund, since TEC is not authorised to operate at full power. He informed me that it_is,their,,

Mr. Eowe stated that we should not proceed with a partial refund unless we hear from him.

Based on my conversation with Mr. Howe, LFMS should not, proceed at thie time to initiate a refund. We should, however, closely monitor the situation and if the power operation is delayed, a partial refund of the operating license fee should,be further considered.
