not later than November 7,1970, scheduling a public hearing on the application of The Toledo Edison Company and The Cleveland Electric illuminating Cenpany for a construction permit for the Davis-Besse Nuclear Power Station in the Ohio National Guard Armory, 133 bes t Perry Street, Port Clinton, Chlo, en Cecernber 8,1970. The prehear-Ing conference would be scheduled for Noverter 23, 1970, at the same loca ti on.
This schedule has been approved oy tne Office of the Atomic Safety and Licensing Scard Panel.
The Comnission was informed en Octcber 22, 1970 (tremorander.. f rom Ce rtram ti. Schur, Acting General Counsel,

d67-371, USCC, M.D., Ohio; Davis-t. esse Cons truction Perrni t Applica-tion), that a petition has been filed seeking a court orcer revoking the'brecons truction permi t exemption" for the Davis-Besse plant.
Also sought is a court order prohibi ting the Comission from holding the construction permit hearing for this plant.
The peti tioner did not request a preliminary injunction. Accord-ingly, neither order can issue until af ter a hearing. The court procedures may take several months to complete.

i Commissioners - The Jus tice Department informally advise (a) there is no legal reason why the Commission should not proceed at this time with the notice of hearing as well as the hearing itself, and (b) It should be anticipated, however, that the petitioner, upcn publication of the notice of hearing, night innediately move to amend his petition to seek a preliminary injunction restraining the holding of the besring.
