ANSWER OF THE DEPARTFENT OF JUSTICE IN SUPPORT OF MOTION 3Y NRC STAFF TO AUTHORIIE THE ATOMIC SAFETY AND LICENSING 30ARD TO CONSIDER A'ID RULE CN CONSOLIDATICT Pursuant to Rule 2.730 of the Commission's Rules of Practice (10 C.F.R. 52.730), the Department of Justice (hereinafter " Depart-ment") hereby supports the Motion by NRC Staff to authorize the Atomic Safety and Licensing Board to consider and rule on consol-idation with regard to the Davis-Besse 2 and 3 proceeding and'the ongoing Perry 1 and 2 and Davis-Besse 1 proceedings.

By filing this .'ncuer, the Department is not taking any posi-tion on whether it favors or opposes consolidation. Thus, the Department is specifically reserving the right to present its position on the r.erits of consolidating these proceedings at the

. appropriate time in the future.

The Department also joins in Staff's request for Commission disposition of Staff's Motion in advance of July 1, 1975.
