STATEMENT OF'AMERICAN MUNICIPAL POWER-OHIO, INC.
INFORMING APPLICANTS OF THE NATURE OF THE CASE TO BE PRESENTED Prehearing Conference Order No. 4, issued by the Atomic Safety and-Licensing Board on August 21, 1975, requires that the parties, other than the applicant, file a statement of ultimate issues for hearing and a summary description of evidence to be introduced rela' ting to each of these issues.
At even date herewith, the City of Cleveland (Cleveland) filed its statement informing the applicants of the nature of the case to be presented.

AMP-Ohio has consistently supported the position asserted by the City of Cleveland in the above-captioned proceedings.
For the purpose of these proceedings, the interests of AMP-Ohio and the City of Cleveland are identical.
AMP-Ohio, in the interest of avoiding duplication of effort and burdening the record herein with material, data and documents identical to those filed by the City of Cleveland, has, where appropriate, adopted and concurred in the various pleadings and documents filed by the City of Cleveland.
Cleveland is a member of AMP-Ohio, and the proposed bulk power supply transaction between AMP-Ohio and Cleveland has been described by Cleveland in numerous documents filed with the Nuclear Regulatory Commission, including the Statement filed by Cleveland on September 5, 1975, (See Statement of City of Cleveland, pp. 3 and 10). AMP-Ohio will rely on the same evidence as-Cleveland in showing that the Cleveland Electric Illuminating Company (CEI) has consistently
~
refused to deal with AMP-Ohio and Cleveland in connection with the proposed transmission and delivery of some thirty (30) megawatts of power available from the Power Authority of the State of New York.
A summary of the evidence to b'e relied upon and a complete statement of the issue raised in connection with this proposed
~
transaction is completely and adequately set forth by Cleveland.
It-is unnecessary for AMP-Ohio to reiterate a summary of the issues and the evidence herein.
