In reference to our earlier telephone conversation regarding firing into i Danger Areas I and II.
I have been advised of no changes to cur present. firing schedule wh,1ch as you know calls for eight to ten days of firing by our t.0 ?.1/:.t battalions one timc each year. Thi., takes place generally in the months of June or July. In ,
addition we fire small arms to include .50 cal machine guns from Camp Perry l almost every week-end from April thru November. All of our firing is made doubly ,
safe by the use of limiting etakes which assure that the guns cannot ha travarsed ,
beyond the authorized azimuth'.

?'e have a joint use agreement with the TR1! Jet Di ision v'hich per-.its them to test their weapons on Tuesday and Thu.cday each week from 130C to 1600 hours0.0185 days <br />0.444 hours <br />0.00265 weeks <br />6.088e-4 months <br />.
Their firing is donc primarily for functional testing and for this purpose they must fire not more than 100 right or left of true north. This keeps them well in l the center of the impact area. I At the present time TR7! is not. testing and in f act do not have cn active v' capons program at this location.

Cadillac Gage did have one testing recuirement and did use the range under TR?l's agrcement for that purpose. 7'e have no formal agrecmtat with Cadillac Cage for testing purposes and do not anticipate that they v.ill h:ve this recuirement in the future.
Ovcr the past few years cur firing f rem Camp perry into Area II has een on the decline due to changes in troop assignments and the trend seems to continue that way. In my opinion we will have no increase in this activity in the fore-seeable future. I think this is also true of any firing from Erie Industrial park.
My opinion is based on the limited types of weapons that can be tested in our presently reduced impact arca. Nothing larger than 4CP'.! Automatic ?!eapons could be tested due to the limited si::e of the impact area (12,000 meters) and limited air space (23,000 ft). From what I understand from the TRV! personnel our military ew weapons in this category.

NCECO-O LAKE ERIE, WEST END, NORTH OF CAMP PERR'1, OHIO DANGER ZONE REGULATIONS - P10 POSED AMENDMENT r
- 1. It is proposed to amend Section 204.187, 33 US Code of Federal Regulationr.
.;overning the use of the waters north of Camp Perry, Ohio in the western end of Lake Erie. (This regulation and proposed amendment does not govern air space which is under the control of the Federal Aviation Administration) .
- 2. This notice has two attachments pertaining to that proposal:
Attachment #1 (green sheet) - Shows the existing Danger Zone and contains the existing Danger Zone regulations.
- Shows the proposed Danger Zone and
) Attachment contains the #2proposed (yellow sheet) amended regulations.
O. The amendments proposed in previous public notices dated 22 November 1967, 15 March 1968 and 25 Tsbruary 1969 were not adopted due to intervening problei.,
and are superseded by this proposal.
- 4. The amendment now proposed in attachment #2 reduces the size of the Danger Zone from the existing Danger Zone, described in attachment #1, by about 76 square miles and provides for a 3.8 mile wide corridor open at all times through the Danger Zone, in an East-West direction.
S. As noted in paragraph d(2) of the proposed amendment, the danger areas shall be open for public use when firing and/or bombing is not scheduled.
Schedules of use, within the limitations of the regulations, will be published by the using agencies.
- 6. Any interested party entertaining objections to the proposed regulations as prescribed above should file a written statement of his objections with this office not later than 4:30 P.M. , Eastern Standard Time, 11 May 1970 .
Protests so filed will be accorded careful consideration.

NCECO-0,204.187 33 CFR, SECT 204.187 EXISTING REGL*LATICNS LAKE ERIE, WEST END, NORTH OF ERIE ORENANCE DEPOT, LACARNE, CHIO (a) Area for artillery firing by Erie Ordnance Depot, Lacarne, Ohio, aerial gunnery and bombing by Air Materiel Cornmand, Wright Field, Dayton, Ohio, and aerial gunnery and rocket strafing by Naval Air Reserve Training Comunand, Grosse Ile, Mich.-(l) The danger zone. That part of Lake Erie bounded as follows: Beginning at a point approximately 2,000 feet inland at latitude 41'33'50", longitude 83'03 '00',thence t. latitude 41*46'45",
longitude 83*11'20"; thence to latitude 41'49'00", l'ngitude 83*05'50":
thence to latitude 41'41'20", longitude 82*S8'30"; thence to latitude 41'33'40", longitude 83'01'30"; and thence to the point of beginning. That part of the danger zone bounded on the southwest by the shore and on the northeast by a line extending from latitude 41'36'9 " longitude 83'00'35",
to latitude 41'41'16", longitude 83'07'54", shall be open for the passage of watercraf t at all times excent whenartillery firino (as provided in subparagraph (2)(1) of this paragraph) or antiaircraft firing (as provided in paragraph (b) of this section) is in progress.
(2) The regulations-(i) Artillery firing. (Area I.) The entire danger zone including the shore passage shall be closed to watercraft generally when artillery firing is in progress. Artillery firing will normally be conducted between 8:00 a.m. and 5:00 p.m. each Wednesday. In the event that firing is to be conducted at other ti.=es, s special notice of such firing and the dates and hours thereof will be published by the enforcing agency in sufficient time to permit circularization to interested parties and posting on the bulletin boards of post offices in surrounding localities. Special notices will also be furnished the District Engineer, Corps of Engineers, Detroit, Michigan, the Cc-mander, Ninth Coast Guard District, Cleveland, Ohio, and the Regierbal Manager, Civil Aeronautics Authority, Chicago, Illinois. Cn all days when artillery firing is to.be conducted, a large red flag vill be displayed

from the range observatien tower at the Erie Ordnance Depot from /:00 a.m.
until firing ceases for the day. In the event that firing is to be conducted during hours of darkness, a r' lashing red light will be displayed from the top of the observation tcwer until such firing ceases.
(ii) Aerial gunnery, beeMng, and rocket strafing. Aerial gunnery, bombing and recket strafing will normally be conducted between 8:00 a.m.
and 5:00 p.m. on all days, including Saturdays, Sundays, and holidays, except Wednesdays and other days when artillery firing is in progress.
Such aerial operations will take place over all that part of the danger zone outside the shore passage. Navigation in the shore pastage will not be affected by aerial operations.

.abdivision (i) of this subparagraph or when a red flaa or flashing red light is displayed from the range observation tower, or in that part of the danger zone outside the shore passage during the ho ra described in subdivision (ii) cf this subparagraph, unless specific permission is granted in each case by one of the representatives of the enforcing agency policing the area in patrol boats. These boats are in constant radio comununication with the Safety Controls station, Erie Ordnance Depet.
(iv) Navigation and fishing permitted. The entire danger zone shall be open to the public for navigation and fishing from 5:00 p.m. to 8:00 a.r throughout the year, except as otherwise provided in subdivision (i) of this subparagraph and a paragraph (b) of this section.
(v) Fishing permits. Fishermen desiring to set fixed nets within the

(vii) Enforcinq agency. The regulations in this section shall be ;
enforced by the Adjutant General, State of Ohio, and such agen-ion oc he may designate. Equipment used in clearing the area will J1y or ca. one a j square red flag.

33 CFR, SECT 204.187 NCECO-O 204.187 EXISTING REGULATIONS (ii) Automatic weapons area. That part of Lake Erie bounded as follows: Beginning at a point on the south shore of Lake Erie at Camp Perry where the water intake pipe-line intersects the shcre-lines
- thence to latitude 41'38'36", longitude 82'56'49": thence to latitude 41'35'31", longitude 82'54'47"; thence approximately 241'15' true to a point on the shore of Lake Erie at the Camp Perry piar thence northwesterly along the shore to the point cf beginning.
(2) The regulations - (i) Antiaircraft artillery firing. Antiaicraft artillery firing will be conducted from 8:30 a.m. to 11:30 a.m. and from 12:15 p.m. to 4:30 p.m., on all days other than Saturdays, Sundays, and holidays between June 16 and November 30, inclusive; firing between December 1 and March 15, inclusive, will be unrestricted as to the days of the week and hours of the day.
(ii) Automatic weapons firing. The automatic weapons arec will be a surface danger sone and closed to navigation only during the firing of such weapons. Special notices of such firing and the dates and hours thereof will be published by the enforcing agency in sufficient time to permit circularization to interested parties r.nd posting on the bulletin
, boards of post offices in surrounding localities. No firing will te scheduled on Saturdays, Sundays and holidays between June 16 and November 30, both dates inclusive.
(iii) Navigation prohibited. No vessel shall enter or remain in a danger zone during a firing period unless specific permissien is granted in each case by one of the representatives of the enforcing egency policing the area in patrol boats. These boats will be in constant radio communication with the Safety Controls Station, Erie Ordnance Depot, and the danger zone will be under radar and visual surveillance when in use.
(iv) Suspension of " firing. The Adjutant General, State of Ohio, shall have the authority to suspend all or any firing for reasonable periods during regattas and immediately after nets are destroyed or dislocated by severe storms.
(v) Warning flags. On days when antiaircraft artillery firing is to be conducted tuo large red flags wi31 be displayed simultaneously, one from the Safety Tower at Camp Perry and one from the most westerly l
. Safety Tower at Locust Point, from 7:00 a.m. until antiaircraf t artillery firing ceases for the day.
(vi) Enforcing agency. The danger sones and the patrolling thereof shall be under the control of the Adjutant General, State of Ohio, and such agencies as he may designate. Equipment used in
- clearing the areas will fly or expose a square red flag.

- a. The danger zone. Ccnsists of the waters of Lake Erie within:
(1) Danger Area I. The sector of a circle with a radius of 6,500 yards centered at latitude 41'32'30"N, longitude 83'01'00"W, and inter-secting the southwest boundary of Area II at latitude 41'35'00"N, longitude 83'03'22"W, and the southeast boundary of Area II at latitude 41'34'20"N, longitude 82*57'10*W.
(2) Danger Area II (Includes Area I) . The area bounded as follows:
Beginning at latitude 41*32'30"N, longitude 83*01'00"W, thence to latitude 41'35'00"N, longitude 83*03'22"W, thence to latitude 41'36'00"N, longitude 83*03'24"W, thence to latitude 41'41'30"N, longitude 83'07'30"W, thence to latitude 41'41'30"N, longitude 83'00'00"W, thence to latitude 41'35'40"N, longitude 82*54'50"W, and thence to the point of beginning.
(3) Danger Area III. The area bounded as follows: Beginning at latitude 41*44'48"N, longitxie 83'10'00"W, thence to latitude 41'47'lS"N, longitude 83*10'00"W, taence to latitude 41'49'00"N, longitude 83'05'50"W, thence to latitude 41'46'15"N, longitude 83'00'00"W, thence to latitude 41'44'48"N, longitude 83'00'00"W, and thence to the point of beginning,
- b. Type of firing.
(1) Danger Area I. Small arms i:apact area (2) Danger Area II. Ground based artillery, antiaircraft artillery I and automatic weapons impact area.
l (3) Danger Area III. Aerial gunnery, (non-explosive) rocket firing, and (nor.-explosive) bombing impact area.
I c. Authorized Dates and Hours of Firing.
(1) Danger Area I. 0600 to 1800 bcurs, EST/EDT, daily. Actual firing dates and hours within the authorized period to be announced in advance in Special Firingr Notices.

(3) Danger Area III. 0800 to 1700 he'ars, EST/EDT, Wednesday through Sunday. Actual firing dates and hours scheduled within authorized period to be announced in advance in Special Firing Notices.
- d. Restrictions:
(1) No vessel shall enter or remain in a Danger Area during a scheduled firing period announced in a Special Firing Notice unless specific permission is granted in each instance by a representative of the enforcing officer.
(2) The danger areas within the danger zone shall be open to I the public for navigation, fishing and other public use when firing j and/or bombing is not scheduled. !
- e. Enforcing Agencies. The regulations in this section shall be enforced for the respective danger areas by the following entmanders j and such agencies as each may designate for his assigned areas. He will be responsible for providing the prescribed centrol, signals, and ,
special firing notices.
Danger Area I -
Adjutant General, State of Ohio l Danger Area II -
Adjutant General, State of Ohio Danger Area III - enamanding Officer, Naval Air Facility, Detroit, at Mount Clemens, Michigan.
- f. Control and signals.
(1) Danger Area I. When firing into Area I, red flags will be flown from the Safety Tower at Camp Perry, and from flag poles in the butts of the ranges being used.
(2) Danger Area II. During all types of firing into Area II, red flags will be displayed, one from the Safety Tower ar Camp Perry and one from the Safety Tower at the Erie Proof Front. During firing l into Area II, patrol boats will police and maintain surveillance of I the area, and will be in constant radio c-micatien with the shore station controlling the firing.

NCECO-O 204.197 PROPOSED AMENDED REGULATIONS (3) Danger Area III. When using Area III aircraft crews will maintain surveillance of the area prior to and during firing / bombing operations. Aircraft will contact and clear through Naval Air Facility, Detroit, by radio prior to and upon departing the area.
(4) The appropriate enforcing officer has authority to suspend any scheduled firing for reasonable periods during regattas and immediately after fishing nets are destroyed or dislocated by severe storms.
(5) The special firing notices which will include schedules of use, will be published by the enforcing officer indicated in paragraph e., in sufficient time to permit circularization to interested parties and posting on the bulletin boards of post offices in surrounding localities.
Special Notices will also be furnished the District Engineer, Corps of Engineers, Detroit, Michigan; the Commander, Ninth Coast Guard District, Cleveland, Chio; the Regional Manager, Federal Aviation Administration, Chicago, Illinois; and each of the other enforcing agencies listed in paragraph e. Users of the waterway shall familiarize themselves with the current Special Firing Notices. If in doubt, inquiry may be made to any of the above agencies.
(6) Agencies desiring to use the Areas shall present their requirements to the respective enforcing officer who is responsible for, and is granted authority to, coordinate the firing and establish priorities, for the using agencies.
- g. Fishing Permits. Fishermen desiring to set fixed nets within the danger zone are required in every instance to have a written permit.
Permits for placing nets within Areas I and II may be obtained by written application to the Adjutant General, State of Ohio. For Area III such permit requests will be addressed to the Ccannanding Officer, Naval Air Facility, Detroit, at Mount Clemens, Michigan. Applicants for permits must state the location at which they desire to set fixed nets and the period of time which they desire the permit to cover.
- h. Injurious Chemicals. No Phosphorus or other poisonous chemicals injurious to wild fowl or fish will be discharged into the waters of the i
