<.>4' It is fully anticipated by the Applicants that an Operating' License for the Davis-Besse Nuclear Power Station Unit ; will be issued in March, 1977. However, if unforeseen circumstances arise which preclude issue of a license by March 31, 1977, the Applicants (The Toledo Edison Company and The Cleveland Electric 111umiaating Company) request pursuant to 10 CFR Section 50.55(b) of the Commission's regulations that the Nuclear Regulatory Commission extend the date for completion of construction of the Davis-Besse Nuclear Power Station, Unit No.

1, from the latest date currently specified in Construction Permit CPPR-80 (April 1, 1977), and continue the Construction Permit to October 1, 1977.

The completion date currently specified on the Construction Permit was based on a revised construction schedule established in early 1975 wnich anticipated start of fuel loading in January, 1976.

Production of power from the Davis-Besse Unit has been and continues to be vitally needed by the Applicants, and we have taken all reasonable measures, consistent with the care required to assure public health and safety, to complete the facility at the earliest possible date.

However, due to a number of circumstances, some of which were beyond our control, the January, 1976 schedule has not been realized and fuel loading is now scheduled to commence March 7, 1977. Since this date falls after March 1, 1977, the date by which a request for an extension of the Construction Permit should be filed, we are hereby requesting this six-month extension to encompass any unforeseen delays in completion of the construction, testing, and NRC licensing and inspection activities, all which must be concluded before authority to load fuel can be granted.

, Among reasons why the January, 1976 fuel loading schedule has not been realized include:

' Rework due to late design modifications and rework / repair to correct deficiencies continue to reduce productivity.

Examples include the modification of the reactor vessel material sur-veillance specimen holder tubes, the rework of the reactor coolant pump suction line welds, the testing of and repair painting on the interior of the containment vessel, and the seal replacement in a large number of hydraulic snubbers.

2.

Lowered construction productivity has also resulted from various adverse union labor relationships. A number of short duration work stoppages have occurred including a one-week (4/30/76 to 5/7/76) walk-off by pipe fitters and electricians.

Also due to a period in which there existed an excess of unemployed union members, under conditions of their contract, the electricians worked only a seven-hour workday frcm June 2, 1975 to July 14, 1975.

Delayed availability of materials and late delivery of equip-ment have hindered the capability to provide timely system turnovers. Valve deliveries have been extremely troublesome.

Suppliers have difficulties obtaining required forgings, production problems result in rework and scrap, tight QC/QA control causes rejections and/or rework and demand creates competition for output.

A great deal of field rework was needed in order to meet new requirements for electrical separation and fire barriers arising from fire protection concerns. The rework has involved many manhours of engineering time as did an engineering inspec-tion of 100% of the installed Class IE essential cable circuits.

This inspection was undertaken to assure proper installation to project design cirteria.

Late development of the NRC Standardized Technical Specifica-tions resulted in additional manhours and rewriting operating procedures, retraining personnel, reviewing existing documents for conflicts and, of course, developing the new Davis-Besse No. 1 Technical Specifications with proper consideration to plant peculiarities requiring special attention.

Late system turnovers from Construction to Operations has placed a severe burden on the Operating Staff to fulfill in a timely manner the stringent requirements of the pre-operational test program.

In view of the fact that the Applicants have expended their good faith best efforts to complete construction as soon as possible, and will continue to do so, in that the reasons for delay have been beyond our reasonable control, we respectfully urge that the extension of the Construction Permit be granted.
