Gentlemen:
'The purpose of this letter is to request information concerning our reporting obligation pursuant to 10 CFR 50.75.
l Duquesne Light Company (Duquesne) owns undivided interests in and i
is a
licensee with respect to two nuclear units, Beaver Valley Unit i
No. -
1, part of a
multiple-unit
- station, and Perry Unit No.
1, a
single unit station.
Duquesne is also a licensee with respect to Beaver Valley Unit No.
2 in which Duquesne is a
lessee of an undivided interest pursuant to a sale / lease back arrangement which was approved by the Nuclear Regulatory Commission on September 23, i
1987.'
With respect to each of these units, the remaining undivided interests are owned in varying percentages by other members of the i
Contral Area Power Coordinating Group (CAPCO).
The CAPCO memberc are Duquesne; Ohio Edison Company and its subsidiary, Pennsylvania Power Company; and the Centerior Energy Corporation companies, The Cleveland Electric Illuminating Company and the Toledo Edison Company.
Under the CAPCO Basic Operating Agreement, Duquesne is the a
operator of Beaver Valley Unit Nos.
I and 2.
Cleveland Electric l
Illuminating Company is the operator of Perry Unit No.
1.
Each CAPCO member _ owning an interest in any of these units is a licensee with i
respect to that unit.
Duquesne has-established external decommissioning funds with r
respect to each unit (Beaver Valley Units No. 1 and 2 and Perry Unit No.
1) and will be prepared to submit a report with respect to its interest in each unit.
Paragraph (b) of 10 CFR 50.75 states, in pertinent
- pert, that each electric utility holder of an operating l
license for a
utilization facility shall submit a decommissioning L
report.

owner / licensee should submit a decommissioning report with respect to i
its interest in each unit, in contrast to the operator of the unit submitting a report on behalf of all owners / licensees of that unit.
We have discussed this with Mr. Frank eardile of your staff in an

effort to obtain clarification of t-reporting requirements;
- however, we believe it is importar.
to obtain your written interpretation to assure proper reporting is achieved.
Our current
- opinion, based on our reading of the regulation, is that each l
owner / licensee should submit a decommissioning report with respect to its interest in each unit.
If the operating licensee is to report on behalf of all owners of a
- unit, the reporting and information gathering burden on the operator changes significantly.
Please
- advise, at your earliest convenience, regarding the reporting requirements expected in order to satisfy 10 CFR 50.75.
