' COMANCHE PEAK STEAM ELECTRIC STATION (CPSES) -l DOCKET NOS 50-445 AND 50-446

(( IEN 89-56, QUESTIONABLE CERTIFICATION OF MATERIAL SDAR: CP-89 026 (FINAL REPORT) i Gentlemen:

- On Septe'nber 22, 1989, TV Electric verbally notified the NRC of a potential  ;

- deficiency involving questionable certification of material. This issue was originally identified in Information Notice 89-56. The'last report on this 3 issue was provided in the TV Electric letter logged TXX-89775 and dated '

October 23, 1989. The purpose of this letter is to inform the'NRC of the results of TV Electric's investigation of the subject Information Notice, and Lto notify the NRC that this condition is not reportable under'the provisions of 10CFR50.55(e) or 10CFR21. -

' Material suppliers Meredith Corporation / Pressure Vessel Nuclear (PVN), and Alloy & Carbon Steel Company, Incorporated (ALLOY) allegedly falsified  :

5 certifications.for material that was sold to Department of Defense-Contractors. According to the Information Notice, the defendants in the -

pending case allegedly falsely marked and stenciled steel, altered certified s material test reports, and prepared false certificates of conformance.

A review of the CPSES procurement documents. revealed that no material was purchased from ALLOY. However, six PVN purchase orders (P0's) were c

identified. One of the six P0's was later concelled due to shipment delays.

A nonconformance report was issued tgainst one of the other six PO's, and the E associated material was not used in a safety related app 11 cation. It was -

l determined that the remaining four PC's included Certified Material Test Reports (CMTR's) involving six differant steel manufacturers and six dif ferent heats. The steel manufacturers were contacted to ascertain the validity of I the'information contained on the CMTR aupplied by PVN. Four of the manufacturers verified that the CMTR's were valid and unchanged. The two

j. other manuf acturers, Inland Steel Company and Auburn Steel Company, indicated that the CMTR's were valid, but that the steel described on the CMTR's was not sold or shipped to PVN as indicated on the CMTR's, i

!' lfour out of'the six manufacturers' heat numbers was still in stock, including the two heats allegedly manufactured by Inland Steel Company and Auburn Steel Company, Samples from these.four heats were selected and tested by an independent

laboratory. Results of the. testing indicate that the steel meets the chemical and physical requirements of the applicable material specifications. Although material from the remaining two heats was not tested, confirmation by the steel manufacturer of the CMTR validity provides reasonable assurance that the material is, in fact, as certified.

Based on the above evaluation, it is concluded that the material- supplied to TV Electric by PVN meets the specified requirements.
