BRIEF OF TOWN OF HAMPTON This paper is. filed pursuant to the Order of the Commission dated October 13, 1989. It responds to the certification of the l Appeal Board dated October 11,. 1989.

Lewis Carroll, author of Alice's Adventures in Wonderland i and Throuah the Lookina class, surely had the present matter in -

mind when he wrote:

"There's glory for you!"

"I don't know what you mean by ' glory'," Alice said.

Humpty Dumpty smiled contemptuously. "Of course you don't--till I tell you. I meant 'there's a nice knock-down argument for you!"

"But glory doesn't mean a ' nice knock-down argument," Alice objected.

"When I use a word," Humpty Dumpty said in a rather scornful tone, "it means just what I choose it to mean--neither more nor less."

The - words used by the - Tribuna.ls in this matter mean that h

'Seabrook will be licensed.

For an agency charged with safety to uphold the exclusion of i testimony which relates, on its face, directly to the safety 2

issues of evacuation is reprehensible in the view of the Town of Hampton.

Tha semantic conundrum is most certainly ' answered in the transcript cf the Commission dated July 23, 1980, in the matter ,

of Discussion and Vote on Emercency Frenar'et_ ness Rula. The word

" appropriate" lost out to " adequate". It is clear from the transcript that " adequate" protection mean " effective" protection.

When the chapter on the history of Emergency Planning is written, surely historians or for that matter, a commission of inquiry, will have trouble sorting out the safety issue from the political exigencies. The inhabitants of the Town of Hampton 1

will live each day with the risk created on the ground by the

' semantice of this Tribunal written on the page. Tnat's a real difference.
