WASHINGTON, D. C. 2C555 f
JUL 2 81980 MEMORANDUM FOR: Thomas J. Carter, Technical Assistant Technical Support Branch Planning & Program Analysis Staff, NRR FROM:
Harold R. Denton, Director Office of Nuclear Reactor Regulation
SUBJECT:
EXEMPTION TO 10 CFR 0.735-21 I have reviewed your Co'nfidential Statement of Employment and Financial Interests (Fonn NRC-269) and note that you report, as a former employee of Rockwell International, a vested interest in their pension plan.
In order to allow you to work on licensing matters involving Rockwell International, an exemption from the provision of 10 CFR 0.735-21 must be granted..
A review of the terms of the Rockwell International pension fund by the Office of the General Counsel has revealed that as an NRC employee you cannot influence, in any fashion, the amount you receive as a pension from Rockwell International. Based upon this finding, I have determined that your interest in the Rockwell International pension fund is not so substantial as to be deemed likely to affect the integrity of your services to NRC and that no provision of law and no NRC regulation would appear to be violated by your participation in matters affecting Rockwell International.
Therefore, with the concurrence of the Office of the General Counsel, you are hereby granted an exemption from the requirements of 10 CFR 0.735-21 and you may participate in matters before the NRC affecting Rockwell International.
