Dear Mr. Felton:
This is a request on behalf of the Union of Concerned Scientists pursuant to the Freedom of Information Act, 5 USC S552, for access to and copieg of various documents in the files of the Nuclear Regulatory Commission relating to Three Mile Island and Indian Point.
We request the following documents:
1.
Three Mile Island unit 2 Startup Problem Report, dated March 30, 1978, docket no. 50-320, as referenced on page 182 of volume 2, part 1 of the Rogovin Report, reference number 332.
2.
Citizens Committee for the Protection of the Environment Proposed Findings of Fact and Conclusions of Law, regarding Consolidated Edison Company of New York (Indian Point, Unit No. 2), docket no. 50-247, dated February 8, 1972.
We anticipate that you will make the requested materials available to the Union of Concerned Scientists within the statutorily prescribed period of ten (10) working days.
We also request that you waive any applicable fees since disclosure to UCS meets the statutory standard of being "in the public interest because furnishing the information can be considered as primarily benefitting the general public." 5 USC S552 (a) (4) (A).
If you do not grant the waiver, however, we authorize you to incur up to $50.00 in costs.
If the cost exceeds $50.00, we request that we be given access to the materials to determine exactly which documents UCS needs.
