INTERVENOR STEVEN C. SHOLLY MOTION TO WITHDRAW CONTENTION # 16 Pursuant to a Board Memorandum and Order, dated 4/21/80, Mr. Blake, Counsel for Licensee, Mr. Adler, and myself entered into negotiations on i

. various matters concerning Sholly Contention #16. During the course of l these negotiations, it became clear that by separating the security forces at IMI (as part of a general separation of the two nuclear units), Licensee had in large measure responded to most of the concerns raised by Contention

Contention #16 was submitted to the parties on 11/29/79 in response to a summary document published by the President's Commission on the Accident at Three Mile Island. The thrust of the contention was' that aia: result' of *

'.f*C the extra numbers of personnel (both Licensee and contractor personnel) at thf island, and the relatively unrestricted' access between TMI-2 andSTMI-l', there was a higher-than-normal risk of internal sabotage at TMI-1, and that unless satisfactorily addressed, this represented a risk to public 51ealth and safety. ,.

The separation of the the TMI units responded 111 large' part to th'is concern. As a result of negotiations between myself,'Mr. Adler,-and Mr. . _ , _ ,

MOTION TO WITHDRAW CONTENTION 16 SHOLLY, 6/10/80 Blake, an understanding was reached whereby if Licensee would commit to restricting ,

access from TMI-2 to TMI-l 'to a small group of individuals, recognizing that there would have to be exceptions ynder certain circumstances, I would withdraw the Contention #16, its concerns having been met. By letter dated 6/6/80, Mr. Blake transmitted to me " Licensee's Statement Regarding Limited Direct Access from Unit 2 to Unit 1, June 6,1980," (copy of letter and statement attached to this filing)'.

Essentially, the cazmitment made by Licensee restricts access from IMI-2 to TMI-1 to levels consistent with those occurring before the accident. In fact, under most circumstances, the canmitment restricts such access to less than pre-accident figures. This answers the concerns raised by my Contention #16; therefore, I move that the Board withdraw this contention from consideration.

This withdrawal is contingent upon an additional commitment from Licensee which provi' des that at any time throughout the Restart proceeding I seek to renew Contention #16 onsthe grounds that Licensee is not abiding by the Statement, Licensee will not oppose on grounds of untimeliness of the request to renew the contention.

I realize that the Board, specifically Dr. Jordan, has additional concerns regarding security. When Dr. Jordan expressed his interest in the security issues at the Prehearing Conference on 5/13/80, I was somewhat surprised at the line which was taken, cince ti.is discussion (I am unable to locate the transcripts in the local PDR, so page citations are not feasible) appeared to me to be outside the scope of the hearing as I understood it. The Board should be aware that I share the concerns raised by Dr. Jordan and several additional concerns regarding security at nuclear power plants, especially TMI. T.ese concerns do not, however, appear to me to have the " nexus" to the TMI-2 accident required as a standard by the Board in judging the acceptability of contentions

4 MOTION TO WITHDRAW CONTENTION 16 SHOLLY, 6/10/80 for this proceeding. Had thi,s proceeding been an operating license proceeding, I would certainly have pursued these concerns in contention form early in the proceeding. -

Should the Board desire a discussion on this point, I will be happy to arrange for this at an appropriate date.

Pursuant to my discussions with you and Mr. Adler, I enclose Licensee's Statement Regarding Limited Direct Access from Unit 2 to Unit 1, dated June 6, 1980.

I understand that based on this statement the concerns evidenced in your Contention 16 have been met and that you intend to withdraw that contention from the T1I Unit 1 Restart Proceeding.

I also understand that you intend to attach or enclose Licensee's Stat.ement with your notice of withdrawal in order that the Board

'will understand, and the record will ieflect that Licensee's position is a basis for your withdrawal of Contention 16. Finally, Licensee agrees that, if at any time throughout the Restart Proceeding you seek to renew Contention 16 on the grounds that Licensee is not abiding by the Statement, Licensee will not oppose on grounds of untimeliness your request to renew.
