Dear Mr. Rusche:

In 1974, the Regulatory Staff conducted an evaluation of the financial status of Consumers Power Company with respect to the Midland Nuclear Plant. Following this evaluation, the Company was requested to continue to inform the Commission of any new information relating to its general financial status and provide the Commission with quarterly reports during the calendar year 1975. This request was contained in a letter, dated September 13, 1974, from Mr. A. Giambusso, then Deputy Director of Reactor Projects. In response to this request, Consumers Power Company hereby submits its report for the fourth quarter of 1975.

With thugsubmittal of the enclosed report covering the final quarter of 1975, an ambiguity contained in Mr. Giambusso's earlier letter has become evident.

While the September 13, 1974 letter clearly states that the quarterly reporting process with regard to construc-tion expenditures is to be discontinued at the close of 1975, it does not indicate whether or not reports con-cerning the other identified topics are to continue beyond 1975 and, if so, at what frequency such reports are to be submitted. In view of the greatly improved financial condition of Consumers Power Company since September of 1974 and in view of the fact that all significant changes in the Company's quality control c, - -

2 and quality assurance program are reflected in its quality assurance manual, a control copy of which is on file at the Commission's Office of Inspection and Enforcement for Region III, it appears that the submission of further reports pursuant to Mr. Giambussn's letter may be unnecessary. Accordingly, Consumers Power Company requests that the Commission relieve the Company of its obligation to further comply with the various conditions and reporting requirements contained in Mr. Giambusso's letter of September 13, 1974.
