Dear IIr. DeYoung:

The following is in response to the questions contained in your letter of March 24, 1972 regarding the effect of the recently effective changes to 10 CFR 50.10 and 50.12 on the Midland facility:

1. What is the percent completion of site preparation activities for the Midland Plant?

Ans: The site preparation activities at the Midland site can best be divided into the following two groups of activities:

Group 1: Clearing and grubbing of land, removal of existing structures, sealing of wells, river widening work, diversion of existing surface drains and construction of temporary facilities.

Group 2 : Site excavation, backfill and recompaction, installation of tral slabs, waterproof me=brane and N working cat, placing of forms and placing and splicing j e

Mr. R. C. DeYourg Atomic Energy Commission Docket Nos. 50-329 and 50-330 March 31, 1972 Ans: None of the activities included in Groups 1 and 2 are 100% complete.

b. What site preparation activities are presently in progress?

Ans: None. Necessary preservation measures and receiving of various materials has continued since work was suspended in Nove=ber 1970.

c. What site preparation activities, not yet undertaken, are still to be accomplished?

Ans: See reply to Q,uestion No 4 below.

3 Does Consumers Power plan to file a request for an exemption from the new regulations to allow work on activities which were being conducted on F. arch 21, 1972 and are now prohibited by the new regulations?

Ans: No. No site preparation activities were being conducted on March 21, 1972.

4. Does Consumers Power plan to file a request for an exemption from the new regulations to allow work on activities, not yet undertaken, which were previously per=itted but are now pro-hibited by the new regulations?

Ans: It is expected that when the approximate date of receipt of a construction pemit becomes sufficiently predictable, Consumers Power will request an exe=ption to permit ad-ditional work on the turbine building substructure, tur-bine foundations, embedments and circulating water pipe.

Additionnily, you requested that Consumers Power verify the fact that the work undertaken pursuant to the exemption for certain construction activities dated July 30, 1970 has been suspended pending completion of the public hearings. All site activities except for necessary preservation measures and material receiving were suspended in November 1970 Nonewhen of theit became apparent that lengthy hearings were in the offing. Consumers activities authorized by the exemption have been completed.

Power does intend to file the show cause information required by 10 CFR 50.12(b ) .
