%f g d This firm, as counsel for applicant, Consumers Power Company, in Docket Nos._Sa=3-2'9X an~d 50-330A, is in receipt of a memorandum by the XE5mic Safety and Licensing Board in the related Docket Nos. 50-329 and 50-330 dated June 15, 1977.

The memorandum appends certain materials dehors the record in Docket Nos. 50-329A and 50-330A, and "suggest[s]" that the antitrust dockets be remanded and reopened.

The Midland antitrust record has been closed for three years, since June, 1974, and the matter has been fully briefed and argued and pending decision by this Board for over a year. The events adverted to in the Hearing Board's memcrandum all postdate the period under examination in the Midland antitrust record. Accordingly, Consumers Power submits that it would be unlawful, and in all events, unnecessary and unjustified, to reopen the Midland antitrust record, so as to further delay the Appeals Board's decision at this time.

However, should the Appeals Board decide to give serious consideration to the Hearing Board's " suggestion",
