NOTICE OF HEARING ON APPLICATION FOR PROVISIONAL CONSTRUCTION PERMIT to the ' Atomic Energy Act of 1954, as emended (the Pursuant Act) and the regulations in Title 10, Code of Federal Regulations, Part 50, " Licensing of Production'and Utilization Facilities", and Part 2, " Rules of Practice", notice is hereby given that a hearing will be held at 10:00 a.m., local time, on October 30, 1968, in the Young Student Center, Arkanste Polytechnic College, Russellville, Arkansas, to consider the application filed under i 104 b. of the Act by Arkansas Power and Light Company (the applicant), for a provisional construction permit for a pressurized water reactor designed to operate initially at 2,452 megawatts (thermal) located on a peninsula in Dardanelle Reservoir on the Arkansas River in Pope County about six miles west northwest from Russellville, Arkansas, and about two miles southeast from London, Arkansas.

Dr. John P. Ceyer, Baltimore, Maryland, has been designated as a technically qualified alternate, and Mr. J. D. Bond, Esq.,
Washington, D.
C., has been designated as an alternate qualified in the conduct of administrative proceedings.
A prehearing conference will be held by the Board at 10:00 a.m.,
local time, on October 15, 1968, in Room 115, Lafayette Building, 811 Vermont Street, N. W., Washington, D. C.
20420 to consider the matters provided for consideration by 8 2.752 of 10 CFR Part 2 and Section II of Appendix A to 10 CFR Part 2.
The Director of Regulation proposes' to make affirmative findings on Item Numbers 1-3 and a negative finding on Item 4 specified below as the basis for the issuance of a provisional construction permit to the applicant substantially in the form proposed in Appendix "A" hetato.

(a) The applicant has described the proposed design of the facility including, but not limited to, the principal architectural and engineering criteria for the design, and has identified the major features or-components incorporated therein for the protection'of the health and safety of the public;
3 (b) Such further technical or design information as may be required to complete the safety analysis and which can reasonably be left for later consideration, will be supplied in tne final safety analysis report; (c) Safety features or components, if any, which require research and development have been described by the applicant and the applicant has identified, and there will be conducted, a research and develop-ment program reasonably designed to resolve any safety questions associated with such features or components; and (d) On the basis of the foregoing, there is reasonable assurance that (i) such safety questions will be satisfactorily resolved at or before the latest dates stated in the application for completion of construction of the proposed facility, and (ii) taking into consideration the site criteria con-

4-facility can be constructed and operated at the proposed location without undue risk to the health and safety of the public; 2.
Whether the applicant is technically qualif'ied to design and construct the proposed facility; 3.
Whether the applicant is financially qualified to design and construct the proposed facility; and 4.
Whether the issuance of a permit for the construction of the facility will be inimical to the common defense and se.curity or to the health and safety of the public.
In the event that this proceeding is not a contested proceeding, as defined by $ 2.4 of the Commission's " Rules of Practice",10 CFR Part 2, the Board will, with'out conducting a de novo evaluation of the application, consider the issues of whether the application and the record of the proceeding contain sufficient information, and the review by the Commission's regulatory staff has been adequate, to support the findings proposed to be made and the provisional con-struction permit proposed to be issued by the Director of Regulation.

In the event that this proceeding becomes a contested proceed-ing, the Board will consider and initially decide, as the issues in this proceeding, Item Numbers 1 through 4 above as the basis for determining whether a provisional construction permit should be itsued to the applicant.
As they become available, the application, the applicant's summary of the application, the report of the Commission's Advisory Committee on Reactor Safeguards (ACRS) and the Safety Evaluation by the Commission.'s regulatory staff will be placed in the Commis-sion's Public Document Room, 1717 H S treet, N.W., Washington, D.C.,
where they will be available for inspection by members of the public.
Copies of this notice of hearing, the ACRS report, the applicant's summary of the application and the regulatory staff's Safety Evaluation will also be available at the office of Everett Ewell, Public Service Director, Arkansas Polytechnic College, Russellville, Arkansas, for inspection by members of the public each weekday between the hours of 9:30 a.m. and 4:30 p.m.
Copies of the ACRS report snd the regulatory staff's Safety Evaluation may be obtained by request to the Director of the Division of Reactor Licensing, United States Atomic Energy Commission, Washington, D. C.

6-Any person who wishes to make an oral or written statement in this proceeding setting forth his position on the issues specified, but who does not wish to file a petition for leave to intervene, may request permission to make a limited appearance pursuant to the provisions of 5 2.715 of the Commission's " Rules of Practice".

Pursuant to 3104 b. o'f the Atomic Enersy Act of 1954, as amended (the Act), and Title 10, Chapter 1, Code of Federal Regulations, Part 50, " Licensing of Productien and Utilization Facilities",
and pursuant to the order of the Atemic. Safety and Licensing Board, the Atomic Energy Commission (the Commission) hereby issues a provisional construction permit to Arkansas Power and Light Company (the applicant) for a utilisation facility (the facility),
designed to operate at 2452 megawatts (charmal) described in the application and amend =ents thereco (the application) filed in this matter by the applicant and t.s core fully described in the evidence received at the public hearing upon that application. The facility, known as Russellville Nuclear Unit, will be located at the applicant's Pope County, Arkansas site on a peninsula in Dardanelle Reservoir on the Arkansas River about sin miles west northwest from Russellville, Arkansas, and a' bout two miles southeast from London, Arkansas.

This permit shall be deemed to contain and be subject to the conditions.specified in 6550.54 and 50.55 of said regulations; is subject to all applicable provisions of the Act, and rules, regulations and orders of the Commission now or hereaf ter in effect; and is subject to the conditions specified or incorporated below:
