Dear Senator Saxbe:
Thank you for providing us an opportunity to respond to Miss Debbie Henry's inquiry concerning the nuclaar power plant to be built near Sandusky.
Miss Henry is most likely referring to the proposed Davis-Besso Nuclear Power Station at Port Clinton, Ohio, proposed as a joint undertaking by Cleveland Electric Illuminating Company and Toledo Edison Company.
The plant would be located on the southwestern shore of Lake Erie approxi-

mately 21 miles east of Toledo and would supply electricity to the 1
northern Ohio area.
The regulatory staff of the Consission (AEC) has coupleted its evaluation of the application to construct and operate this facility.
The notice of hearing on the application, a copy of which is enclosed, has been pub-lished in the Federal Register.
The AEC's safety review and reactor licensing procedures are explained in the enclosed panphlet, "Licens ing of Power Reactors."
With respect to possible thermal ef fects of nuclear power plant opera-tions, Toledo Edison Company announced on July 31, 1970, that the plant would use a closed cycle cooling tower system.
The conpany expects only

a limited discharge of water containing waste heat from the plant.
The Water Quality Act of 1965 provides a progran through which water quality standards are developed by the States and approved by the Secretary of the Interior. Under this program, the Secretary of the Interior would approve water quality standards for Lake Erie.
Further, the recently enacted Water Quality Improvement Act of 1970 requires applicants for a construction permit and operating license for any nuclear power plant which would discharge effluents into the

navigable waters of the U.S. to' provide the AEC with certification from the State or interstate pollution control agency, or the Secretary of the Interior, as appropriate, that there is reasonable assur.tnce that the plant will not violate applicable water standards. The LEC would
