MEMORANDUM OF SQUIRE, SANDERS AND DEMPSEY OPPOSING MOTION OF THE CITY OF CLEVE' GD FOR AN ENLARGEMENT OF TIME FOR FILING ITS BRIEF IN SUPPORT OF EXCEPTIONS On November 16, 1976, the City of Cleveland, Ohio (City) filed a motion for an enlargement of time to January 28, 1977 for filing its brief in support of exceptions on its appeal to the Atomic Safety and Licensing Appeal Board (Appeal Board).

Squire, Sanders and Dempsey (SS&D) opposes the City's motion.

The Appeal Board instructed the parties and the Special Board Established For 10 CFR 52.713 Proceeding (Sp,ecial Board) to move with prompt-ness in resolving the City's motion to disqualify SS&D. The Special Board refused to enter a stay c.f its order dismissing the City's motion for dis-qualffication, presumably so that the disqualification issue night be promptly resolved.

The extension requested by the City interposes an unwarranted de-lay in these proceedings. The City points to a Menorandum of Understanding 8008060 N m

between CEI and the administration of the City of Cleveland which might render the disqualification issue moot. However, the Cleveland City Council has not approved the Memorandum of Understanding and it is far from certain that a sale can be consummated in light of current developments.

Moreover, Squire, Sanders and Dempsey's motion to dismiss the disqualification proceedings raised only legal issues. These were care-fully briefed and argued by both sides before the Special Board. No origi-4 nal legal research is required in a presentation of the parties' views to the Appeal Board.

In order to accommodate counsel for the City, counsel for SS&D would not oppose an enlargement to December 28, 1976. It would vigorously oppose an extension beyond that time. The accused law firm of Squire, Sanders and Dempsey is entitled to have the charges against it resolved promptly.
