PARTICIPATION IN AEC PUBLIC HEARING ON

DAV!S-3 ESSE. NUCLEAR POWER STATION The Atomic Energy Commission will hold a public hearing to be conducted by on Atomic Safety and Licensing Soord to determine whether the construction permit issued to The Toledo Edison Com-pony and The Cleveland Electric illuminating Company author-izing construction of the proposed Davis-Besse f4uclear Power Sto-tion in Ottawa County, Ohio, should be continued, modified, termi-noted or appropriately conditioned to protect environmental vol-ues. The hearing will be held in the vicinity of the proposed facility at a time and place t 4 be set later.The issues to be considered at the hearing are specifiM in a FEDERAL REGISTER notice published on January 5,1973.
Members of the public who wish to participate in the hearing may do so in one of two ways:

- 1. They may make a limited appearance. A person making a limit-g
- o ed appearance does not become a party to the proceeding but
{}5 may state his position'ond raise questions which he would like to y
have answered to the extent that the questions are within the scope of the hearing and are permitted by the Licensing Board, pg$
Persons desiring to make a limited appearance are requested to q 0; m-inform the Secretary of the Commission, U.S. Atomic Energy 3jq Commission, Washington, D.C. 20545, Attention: Chief, Public Proceedings Stoff, by February 5,1973. Limited appearances will be permitted at the time of the public hearings by the Licens-ing Board.
- 2. They may petition for leave to intervene. A person permitted to intervene becomes o party and has a right to participate in the conduct of the hearing. For example, he may present evidence and examine and cross-examine witnesses.
Any person.whose interest may be offected by the proceed-ing who wishes to participate os a party must file o petition for leave to intervene under oath oroffirmation setting forth the in-terest of the petitioner in the proceeding, how that interest may be offected by the results of the proceeding, and the petitioner's -
contentions with respect to the proposed licensing action. Such petition must be filed with the Secretary of the Commission, U.S.
Aton-ic Energy Commission, Washington, D.C. 20545, Atten-tion: Chief, Public Proceedings Stoff, by February 5,1973.
A petition for leave to intervene must be accompanied by a supporting offidavit which identifies the specific aspect or as-pects of the proceeding as to which intervention is desired and specifies with particularity the facts on which the petitioner relies os to both his interest and his contentions with regard to each aspect on which intervention is requested.
All petitions will be acted upon by the Licensing Board. Those petitions stating contentions relating only to matters outside the Commission's ivrisdiction will be denied.
