A. The aforesaid letter and memorandum are attached to the City's principal briefl and identified as Exhibit E.

B. The exhibit is referred to on pages 8-10 of the Majority Memorandum and pages 6-7 of the Dissenting Memorandum. It is also referred to on p' ages 12-14 of Squire, Sanders & Dempsey's Trial Memorandum.2 _

A. He aforesaid letter and memorandum are identified as Exhibits A and B respectively and are attached to the Majority Memorandum.

Squire, Sanders & Dempsey's employment for the 1972 bond ordinance. Paragraph 6 on page 4 thereof was evidence that the complaint against CEI by the City was filed on May 13, 1971, being docketed as-City of Cleveland vs. Cleveland Electric Illuminating Company
