Oconcerninglenstruction activities at the Davis-Besse' site. Pur-U

'suant to 10 CFR 50.12 of the A'temic Energy Cometission's regulations an exempties from the requirements of 10 CFR 50.10 was granted by the Co==iasion en September 10, 1970 to The Toledo Idison Company and The Cleveland Electric Illuminating Company (the applicants) to permit eartain; below grade reinforcing steel placement and con-crste femadations'cometructions to be performed prior to the issuance of a construction permit for the Davis-Besse Nuclear Power Plant.

l On January 7,1971, while the public hearing on the application for a construction permit was in progress, the applicants requested a further exemption to permit additional below grade construction work on the Davis-Besse Nuclear Power Station.

On January 25 and'26, 1971, LIFE, an intervenor in this proceeding, requested that either the presiding Atomic Safety and Licensing Board (ASLB) issue anJorder denying the exempties request or that the pre-coeding be 'adjoursed pending disposition of the request.: On January 27, 1971, the ASL3 issued an order that the Director of Regulation not issue an extenoien of the exemption sought by'the applicants until after the filing of the Board's initial decision in this' matter. The ASLB hss referred this ruling to the Atomic Safety and Licensing Appeal Board for"rs. view.
