Dear Mr. Sheerer:
I am pleased to respond to your letter of July 29, 1970, concerning the public hearing on the Davis-Besse plant.
The application of the Toledo Edison Company for the Davis-Bense Nuclear Power Station is presently under review by the regulatory staff and a public hearing on the application is not expected to bo held before Noverber or December 1970. The Atomic Energy Act of 1954, as amended, requires that the Commission provide at least a 30-day notice of such hearings, and the notice vill set forth the day, time, and place of the hearing, and the procedures by which a member of the public may participate in the hearing either as a party or by means of a limited appearance.
I have asked the Public Proceedings Branch of the Office of the Secretary to the Con::nission to forward you a copy of the Notice of Hearing on the Toledo Edison Company's application when it is issued.
I an enclosing a copy of a Comission pamphlet " Licensing of Power Reactors," which will provide you with considerable background information on the scope of the Comission's review, and a copy of 10 CFR Part 2, the Comission's " Rules of Practice," which sets forth the various procedures applicable to the conduct of the public hesrings. I would invite your attention in particular to 10 CFR II 2.714, 2.715 and Appendix A.
