CITY OF CLEVELAND'S MOTION TO STRIKE APPENDIX TO APPLICANTS' REPLY BRIEF City of Cleveland (City) moves to strike Appendix A to Applicants' Reply Brief filed with the Atomic Safety and Licen-sing Appeal Board (Appeal Board) on August 4, 1977 in the above entitled matter.

By' order of January 19, 1977, the Appeal Board established a limit of 100 pages for Applicants' Reply Brief. By order of January 27, 1977, the Appeal Board reaffirmed the page limitations previously established by its January 19, 1977 order and pointing out that the Commission's Rules of Practice do not sanction the ,

1 filing of reply briefs as a matter of course. Further, the Appeal Board said at page 4:

We wish to make clear now, however, that we I will not countenance the filing of briefs in l excess of the page limits we have set. Any such non-complying documents received will be returned unread to the party submitting them.

m On August 4, 1977, Applicants submitted a 100-page Reply Brief. Attached to Applicants' Reply Brief is a 16-page Appen-dix A, which Applicants have characterized as (Reply Br. fn. 1) :

A series of charts which show by page reference where each of the parties discussed the find-ings of fact ("F/F") set forth in the Initial Decision. The similarity in the Licensing Board's language and record citations, on the one hand, and the language and record citations used by our adversaries, on the other hand, is striking. In those few instances where the opposing parties have ventured beyond the four corners of the Initial Decision to make a sup-porting argument, we have so indicated in the Appendix by footnote reference and marginal comment.

Even the most cursory examination of Appendix A to Appli-cants' Reply Brief reveals that it is much more than a mere table of parallel citations. Rather, in Appendix A, Applicants have undertaken to discuss, analyze and argue, the factual argu-ments made by City,the Department of Justise and NRC Staff in their briefs. By this transparent subterfuge, Applicants' seek to evade the page limitations established by this Appeal Board.

In doing so, they make a mockery of its January 19 and 27 Or-ders.1/

The other parties to this proceeding have complied with the i page limitations established for this proceeding. It would be unfair and prejudicial to City to permit Applicants to evade those

-limitations through artifice.

Moreover, the excessive argumentation placed in footnotes
