Report Summarizing Actions Taken By The i

Nuclear Regulatory Commission Under The Program Fraud Civil Remedies Act of 1986 For FY 1989

Background

In october 1986, Congress enacted the Program Fraud Civil Remedies Act to provide Federal agencies with an administrative process and remedy to recompense the Government for losses resulting from false, fictitious, and fraudulent claims and statements.

See subtitle B - Program Fraud Civil Remedies of the Omnibus Budget Reconciliation Act of 1986, P.L.99-509, 31 U.S.C. S 3801 11 331 Purpose of the Report The act requires each authority head to prepare and transmit to the appropriate connittee and subcommittee of Congress an annual report sumskriring actions taken under the Act.

The report is to contain 1.

A summary of matters referred during the previous l

12 months by the investigating official of the authority to the l

reviewing of ficial of the authority under 31 U.S.C. S 3803(a) (1);

2.

A summary of matters transmitted to the Attorney General under 31 U.S.C. S 3803 (a) (2) during the previous 12 months; 3.

A summary of all hearings conducted by presiding officers under 31 U.S.C. S 3803(f) and the results of such hearings during the previous 12-month paried; and 1

L 4.

A summary of all actions taken during the prior 12-month period to collect any civil penalty or assessment imposed under this chapter.

Summary of Actions Taken The Office of the Inspector General of the Nuclear Regulatory l

Commission was first established on April 15, 1989.

Prior to the l

establishment of this office, the Nuclear Regulatory Commission was not an " authority" as defined by the Program Fraud Civil Remedies Act, 31 U.S.C. S 3801 et seq., and was therefore not within the jurisdiction of the Xct.

Regulations implementing the Act have not yet been promulgated pursuant to 31 U.S.C. S 3810.

No actions reportable under the Act have been taken during the 12-month period ending September 30, 1989.
