Dear Ms. Russell:
On September 13, 1989, the School of Oceanography, University of Washington, requested a license to authorize the export of an uranium isotope sample to the Institute of Earth Sciences, Hebrew University of Jerusalem in Israel.
The application (XSNM02479) was referred by the Nuclear Regulatory Commissioa (NRC) to the Executive Branch, according to our estaolished procedures, for n eview and comment as to whether the issuance of t.he license would meet the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear i
Non-Proliferation Act of 1978.
As lead agency for the Executive Branch, the Department of State has informed the Commission' that the necessary determinations under the Atomic Energy Act, as amended, cannot be made for a recommendations of approval, and has recommended that the license request be denied.
Under NRC Rules and Regulations (10 CFR 110.44(d)), the Commission will deny any export license application for which ti.e Executive Branch judgment does not l
recommend approval.
Accordingly, your application is denied.
