  • NOTICE OF VIOLATION Illinois Power Company Docket No. 50-461 Clinton Power Station License No. NPF-62 Clinton, Illinois As a result of the NRC Office of Investigaticns Report No. 3-85-004, dated April 18, 1969, and in accordance with 10 CFR Part 2. Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1988), the following violation was identified:

10 CFR 50.7 states that discrimination by a Comission licensee, permittee, an applicant for a Comission license or permit, or a contractor or subcontractor of a Commission licensee, permittee, or applicant against an employee for engaging in certain protected activities is prohibited. Discrimination includes discharge and other actions that relate to compensation, terms, conditions, and privileges of employment.

(1) The protected activities include but are not limited to:

(1) Providing the Comission information about possible violations of requirements imposed under either of the above statutes.

Contrary to the above, in the sumer of 1984, the National Inspection and Consultants (NIC) Field Services Vice President in charge of NIC em)1oyees at Clinton Power Station informed approximately 30 NIC inspectors at tie NIC office in Heyworth Illinois that any NIC inspector going to the NRC with a safety concern weuld be terminated. NIC was a subcontractor to a Comission licensee and the threat of employment termination against NIC inspectors for engaging in protected activities constitutes discrimination because the threat

changed a condition of employment.

This is a Severity Level IV violation (Supplement VII).

l The inspection showed that actions had been taken to correct the identified j

violation and to prevent recurrence.

Coasequently, no reply to the violation is required and we have no further questions regarding this matter.
