Dear Mr. Olivier:

L Thank you for your letter dated September 21, 1989, subject:

NRC Access To Offshore Platforms.

NRC inspectors will be happy to comply with those personal safety :t.nd site access measures referenced in your letter. We also will make every effort to give you advance notice of our planned inspections at one of your platform sites. We do ask, however, that you not inform the NRC licensee to be inspected of such planned activities for, as we indicated in our August 30, 1989, letter to your company, we normally de not announce inspections to our licensees. Also, as indicated in our August 30 letter, we will issue a purchase order for any transportation services furnished by you and will pay your invoice issued pursuant thereto.

Such invoices will be issued, as we understand it, on the same basis as you invoice personnel of non-eperating working interest owners.

As to your indemnification request, the United States is generally responsible for injury or loss of property or personal injury or death caused by the negligent or wrongful act or omission of any employee of a Federal Agency when such an employee is acting within the scope of his or her office or employment, under circumstances where the United States, if a private person, would be liable to the claimant in accordance with the law of the place where the act or omission occurred consistent with the provisions and limitations of the Federal Tort Claims Act. With respect to independent contractors or agents, we do not plan for or anticipate their presence during any of our inspections on your platforms.
