LLW Forum Meeting

-The' Low-Level Radioactive Waste Forum held its quarterly meeting on October 5-6,

-1989 in Portland.. Maine. Marie Miller, Region I, and Paul Lohaus and Robert 1

MacDougall, WSS. represented the NRC. Participants discussed State and Com-pact progress in LLW disposal site identification and developments findings-

.and recommendations of the the Office of Technology Assesssent LLW report,

. mixed waste as presented by EPA'and NUMARC, and the 1990 milestone and certiff--

-cation review process. The Forum also received updates on NRC and 00E LLW

. activities and on the American Nuclear Insurers policy-on liability. Also discussed were State concerns with the National Governors' Association con-sideration of its LLW policy the scope and rationale of the NUMARC *BRC" petitionand'theNRC:timetabIeandproceduresforconsiderationofthepetition.

On October 4j 1989. during which the Forum sponsored a risk communication workshop EPA s Office of Radiation Programs acted as facilitator in addressing the need for risk communication and the role of the media in risk communication.

Intervenors Move To File Contentions with ASLB Regarding Seabrook -

September 27. 1989 onstte EP Exercise On September 28, 1989, the Massachusetts Attorney General, the Seacoast Anti-Pollution League, and the New England Coalition on Nuclear Pollution jointly requested an ASLB t. aring on the September 27, 1989 Seabrook onsite EP exercise. The Intervenors contend that the exercise was not

" full-scale" and did not test a significant number of observable portions of the site emergency response plan.

Project Quality Assurance Program Plan (H8N QAFP) Revision 4 and the Reynolds ElecticalandEngineeringCompany(REECo)QualityAssuranceProgramPlan(QAPP)

. Revision 8.1The NRC staff found that both QAPP's meet the applicable QA criteria of Subpart G to 10 CFR Part 60 and Appendix 8 of 10 CFR Part 50 and L

that the plans are, therefore, fully acceptable. These two QAPP's are the L

first DOE contractor plans that have been accepted by the staff.

International Visitors On October 5,1989, Region II was visited by representatives from seven foreign countries. The individuals are currently assigned to INP0 as part of a foreign exchange program. The meeting consisted of discussionsIn related.to the NRC's mission and the Regional ins section program.

i addition, the delegation was provided a-tour of tie office including the

. Incident Response Center, Radiochemistry Laboratory, and NDE Laboratory.

Zion Nuclear Power Station o

Mr. H. J. Miller and members of his staff met with Commonwealth Edison Company representatives in the Region !!! office on Octob'er 4, 1989.

Commonwealth Edison Company presented their analysis of the Zion Station requalification program effectiveness based on the results of the NRC11, 1989.

requalification examinations administered the week of September Five of twelve operators taking the examination failed at least one The Zion portion of the examination and were removed from shift.A Confirmatory Action requalification program was rated unsatisfactory.

Letter was issued on October 6,1989, identifying the corrective measures

1. ;FOIA Requests on Vendor. Issues The Vendor Inspection Branch has received FOIA requests on molded case circuit breakers (Bulletin 88-10 and IN 88-46 and Supplements 1-4) and

' Meredith Corporation (IN 89-56) which will be very extensive and resource intensive. -Several thousands of pages of documents are subject to listing for the FOIA' requests. Branch management is working with the NRR FOIA i

coordination staff to develop ap)ropriate responses. Contractor support is being considered to augment tie Branch efforts.

BWR Owners Group Stability Committee Meeting The staff met with the BWR Owners Group Stability Connittee on l

Sept *mber 27 to review the status of the generic recommendations for long term actions to assure protection against neutron flux oscillations as discussed in NRC Bulletin 88-07, Supplement 1.

The status of GE, EPRI, and NRC code validation and analytical studies to assess the impact of oscillations associated with ATWS events was also discussed. The Technical E

Program Group (TPG) formed by NRC/RES to carry out stability research participated in the meeting.

The Owners have concluded that four approaches to assure automatic protection are feasible. The concepts involve power / flow based insertion of control rods to avoid operation in regions of potential instability or reactor protection circuits designed to detect and respond to local neutron flux oscillations. The staff provided positive feedback on all of the concepts in principle. Details of the methods for definition of excluded regions and protection system setpoints must be submitted for review since it involves new application of decay ratio calculations and new combinations of LPRM circuits. Non-conservative definition of the boundarieswoulddefeattheeffectivenessoftheprotection(e.g.,a foreign reactor with automatic select rod insert features experienced instability because the exclusion region was too small). Funding for the BWROG analyses to implement the )roposed solutions must be approved i

L by the BWR Owners. We are hopeful t1at generic licensing issues associated with this approach can be resolved by early next year.

4 On September 26, the staff received NED0-31709, a GE report on the results of a' BWROG study to evaluate the effects of large amplitude thermal.

hydraulic-limit cycle oscillations on average core power. The primary purpose of this study was to assess the impact of oscillations on previous ATWS evaluations.and existing ATWS response procedures. The Owners concluded that previous ATWS evaluations are valid and there is in impact on ATWS actions. However, cased on a brief look'at the report, the staff

' believes that this conclusion is not supported by the results presented in

.the report nor hy preliminary results of NRC studies. The NRC studies ir.dicate that there-is significant contribution (about 25 of the peak power) to average power level increase as a function of oscillation am)11tude (independent of additional' system effects related to core inlet su> cooling). Therefore, additional analyses are needed to evaluate the maximum amplitude of oscillations and the impact of large amplitude

-oscillations on various ATWS scenarios. We are in the process of defining the integrated analytical effort which can most efficiently achieve these objectives, considering the analytical tools available to NRC and the Owners. We expect to issue a letter evaluation of the BWROG submittal, and will advise them of the additional calculations that are needed to resolve the issue.

SAFEGUARDS l

Domestic Physical Security Inspection Program The'DivisionofSafeguardsandTransportation(NMSS)hassenttheFY90 physical security inspection program to the Regions. For the Category I fuel facilities, the FY90 inspection program represents a departure from previous years, since inspection programs will be performance oriented.

Transportation Meeting on Model No. 72-B Shipping Package On September 28, 1989, Transportation Branch staff met with the Department of Energy (DOE), Westinghouse, and Nuclear Packaging, Inc. (NUPAC) to discuss the Model No. 72-B. shipping package. The package would be used to ship L

remote-handled transuranic wastes from DOE defense-related facilities to the WasteIsolationPilotPlant(WIPP). The package, with impact limiters, is approximately 16 feet long 6-1/2 feet in diameter and weighs approximately L

L 45,000 pounds. The Model No. 72-B is designed to provide double containment and would have lead shielding. An application is expected in February 1990.

INDUSTRIAL AND MEDICAL NUCLEAR SAFETY Fuel Cycle Safety Babcock ~and Wilcox Company. Naval Nuclear Fuel Division slig1tly irradiated (zero power)(B&W) requested a license amendment to pro In A)ril 1989, Babcock 8 Wilcox fuel in their uranium recovery system. The

-licensee did not plan to treat the waste liquid to remove fission products to maintain effluent releases as low as reasonably achievable. At an October 3, 1989,' meeting to discuss this issue, B&W representatives described their evaluation of a proposed liquid waste treatment system which conservatively will remove at least 84 per cent of the fission products from the liquid effluent.

The fission products will be solidified and shipped to waste burial. The Fuel Cycle Safety Branch staff agreed that the treatment plan appears acceptable.

Accordingly, the licensee agreed to submit a revised application to include liquid effluent treatment.

. Mountain Project Office (YMPO) audit of Reynolds Electrical and Engineering Company (REECo) in Las Vegas, NV.

REEco is the DOE /YMP0 contractor for surface and subsurface construction, drilling, and mining for the high-level waste repository.

Because there is no quality assurance (QA) level 1 or 2 work ongoing at REEco, the audit was limited to verification of readiness for implementation rather than verification of implementation. The staff agreed with the DOE audit team's conclusion that there are enough controls in place to begin implementation of the program to perform QA level 1 and 2 work.

Office for Analysis and Evaluation of Operational Data Items of Interest Week Ending October 6,1989 DivisionofOperationalAssessment(DOA)

On October 2, the IRB Section Chief, Operations Officer Section, began a 6-week rotational assignment as Chief, Operations Branch, in Region III.

On October 4, the NRC Headquarters emergency response team conducted an exercise with Region I and Northeast Utilities simulating an accident at Millstone 1.

Commissioner Rogers was the Executive Team Directer. The exercise was observed by a staff member from the Senate Committee on Public Works and the Environment, by repretentatives from the State Department, including the Deputy Assistant Secretary for Nuclear Energy and Energy Affairs, and a representative from Northeast Utilities. This exercise demonstrated the ability of the Headquarters staff to monitor and evaluate a licensee's actions over an extended period while L

the Regional team was in transit to the site.

On October 4, the AE0D Deputy Director and staff members attended the 1989 Nuclear Safety Issues / Nuclear Rulemaking Seminar sponsored by the Nuclear p

Utilities Service to discuss needed improvements in reporting of events by licensees.

The first Babcock and Wilcox (B&W) Technology Course for Cross Qualification (R-326P) was completed on September 29, 1989. This course was designed and developed to allow students who have successfully completed initial qualification inanotherpressurizedwaterreactor(PWR) technology-(eitherWestinghouseor Combustion Engineering) to qualify in B&W technology in less time. Course presentations and examinations are at the_same level of detail as those associated with the technology and advanced technology courses of the I

full-course series for a particular reactor technology.

The TTC staff conducted a special simulator course on the boiling water reactor o

(BWR)simulatorformembersoftheMexicanComisionNacionaldeSeguridad Nuclear y Salvaguardias (CNSNS) (counterpart regulatory agency) on October 2-6, i

1989. This course followed a special reactor technology course presented in i

Mexico last October. This course included exercises associated with reactor

startu ), operations, and emergency operating procedures. This is the first time t1at the TTC has conducted a course in the USA with all international programs students.

Division of Safety Programs (DSP)

-On September 29, 1989, AEOD issued Technical Review Report T916 " Debris in Containment Recirculation Sumps." The report evaluated known occurrences of debris accumulation in containment sumps. Actual accumulation of debris in containment sumps was found to have occurred only at the Surry and Trojan plants. The Surry occurrence was addressed in Information Notice No. 88-87.

At the Trojan facility immediate corrective actions have been completed and long-term programmatic actions are being implemented.

On Monday and Tuesdby, the NRC technical staff met with the Japan Agency of Natural Resources and Energy (ANRE), Ministry of International Trade and Industry, for_ the fifth regular meeting on nuclear regulatory matters. The 20-member Japanese delegation, headed by ANRE Deputy Director General Jun-ichiro Mukai, met with. Tom Murley, Director of NRR, and his staff for two days to discuss current licensing issues (on topics including:

license renewal and aging phenomena, and severe accidents) before they began three days of site visits-that included tours of TMI and Limerick nuclear power plants and the Brookhaven National Lab.

Items of Interest Week Ending October 6,1989 Significant Enforcement Actions A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $280.000 was issued October 5, 1989 to Portland General Electric Company (Trojan). The action was based on a number of significant safety violations

-that have been aggregated into a single Severity Level !! problem for an i

inoperable containment recirculation sump function. The civil penalty was escalated 50% because the NRC identified most aspects of the violations, 50% for poor past performance, 100% for the prior notice of similar events, and another 100% because some of the deficient conditions may have existed since initial startu). The civil penalty was mitigated 50% because of the corrective actions w11ch included extensive management changes.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $6,250 was issued October o,1989 to Atlas Corporation, Grand Junction, Colorado. The action was based on a violation involving the release of redon-222 concentrations to an unrestricted area in excess of 220 percent of the maximum permissible concentrn. ions permitted by 10 CFR 20.106, when averaged over one year.

(EN89-94) l On March 31, 1987, the staff issued an Order Suspending Rower Operation and Order to Show Cause to Philadelphia Electric Company (Peach Bottom).

The action was based on inattentive operators over an extended period of time. On October 5, 1989, a letter terminating the requirements of the l

Order. The letter is based on the fact that all conditions of the Order have been met and the staff is presently satisfied with the licensee's performance.

Civil Penalties Paid SouthCarolinaGas&ElectricCompany(SummerNuclearStation)paidthecivil penalty in the amount of $25,000. The action was based on inadequate management controls that allowed a licensed senior reactor operator, who failed a portion of his annual requalification exam, to assume the duties of the operator-at-the-controls prior to retraining and retesting.

Due Power Company (Catawba) paid the civil penalty in the amount of $75,000.

The action was based on violations involving an inoperable Unit 2 Containment Air Return Hydrogen Skimmer Train caused by a design modification wirin error and the licensee s failure to report a condition prohibited by technica specifications.

(EA89-46) 1.ee County Community Hospital, Pennington Gap, Virginia paid the civil penalty in the amount of $2,500. The action was based on a violation which the NRC-required record of a quarterly Radiation Safety Comittee meeting was fabricated by copyin the minutes of a previous meeting and changir.g just the date.

Millstone Unit 1 Emergency Exercise On October 4, the NRC participated with the licensee Northeast Utilities.

l in the annual emergency preparedness exercise at Millstone Point Unit 1.

Participants also included the State of Connecticut and various local towns near the Millstone Point Station. The NRC participation included both Region I and Headquarters response teams. Comissioner Rogers headed the Headquarters Executive Team. The region demonstrated real time deployment of the Site Team, j

Seabrook On Wednesday, September 27, the Seabrook annual emergency exercise was observed by the NRC (FEMA did not observe).

No licensee weaknesses or inadequacies were identified.

NRC staff concluded the licensee actions were adequate to protect the health and safety of the public.

Nine Mile Point By letter dated September 22, 1989, FEMA Region II, has given New York State four months to correct two inadequacies identified in the New York i

State Radiological Emergency Plan as it applies to Nine Mile Point and FitzPatrick. The first inadequacy relates to an insufficient number of available busses and other transportation vehicles for evacuation of schools and transportation dependent population within the EPZ. The l

second inadequacy is associated with incomplete emergency worker training.

Haddam Neck Commissioner Rogers visited the Haddam Neck Plant on September 29.

He was accompanied by Malcom Knapp, Director, Division of Radiation Safety and Safeguards, Region I, and the resident inspectors.

Nine Mile Point. Unit 1 On October 3,1989, Niagara Mohawk representatives met with the NRC Nine Mile Point Unit 1 Restart Panel and briefed the Panel on the status of implementation of the licensee's Restart Action Plan and on the Company's assessment of its readiness for an NRC Integrated AssessmentTeamInspection(IATI). Based on the results of this meeting, the Panel decided to conduct the IATI as previously scheduled.

The Team will hold its entrance meeting on October 4,1989, with the

Limerick Units 1&2 On Wednesday, October 4, 1989, ten delegates to the fifth NRC-ANRE/MITI i

met on regulatory matters toured Limerick 112 and the Region 1 office.

The Japanese delegation was headed by Mr. Tadahiro Mamada. Deputy Director, i

Nuclear Safety Administration Division, ANRE/MITI.

The Regional Administrator and a project manager from Headquarters accompanied the Japanese delegation.

On October 3, Connissioner Rogers, accompanied by the Deputy Director, DRS, was at the Grand Gulf facility for a familiarization tour and to meet with the Resident Inspectors and licensee personnel.

Virginia Electric and Power Company On the evening of October 3, the Regional Administrator and the Director, DRP, were in Richmond, Virginia, to present certificates to the newly t

licensed operators at the Surry and North Anna Nuclea:a Power Stations.

On October 4, the Regional Administrator and selected members of the staff r

were at the Surry Nuclear Power Station to present the SALP results to i

Virginia Electric and Power Company representatives.

In attendance at the i

SALP Board Meeting were the Chairman of the Board, all Board Directors, and the Chief Executive Officer of Virginia Power.

Test. Research and Training Reactors Conference On October 5, the Acting Director, Division of Reactor Safety, spoke at the Test;, Research and Training Reactor Conference in Raleigh, North Carolina, on the subject of Operator Requalification Exams. Selected members of the Region II and Headquarters staffs also attended this conference.

Carolina Power & Light Company On October 2, represenatives of the Carolina Power & Light Company were in the Region II Office to attend an Enforcenent Conference to discuss the l

issues related to Auxiliary Feedwater Pumps at their Robinson facility.

5.

International Visitors On October 5,1989, Region II was visited by representatives from seven foreign countries. The individuals are currently assigned to INPO as part of a foreign exchange program. The meeting consisted of discussions related to the NRC's mission and the Regional ins)ection program.

In addition, the delegation was provided a tour of tie office including the l

Incident Response Center, Radiochemistry Laboratory, and NDE Laboratory.

The group represented government agencies, utilities, vendors and sup-pliers.

LaSalle Nuclear Power Station On October 6,1989, Mr. A. Bert Davis, Regional Administrator, Mr. E. G.

Greenmen, Director of the Division of Reactor Projects, and members of the regional staff met with the Senior Vice President of Commonwealth Edison Company and members of his staff to discuss the results of the licensee's investigation into RPS anomalies observed during a Unit 2 scram on August 26, 1989. The meeting also addressed the status of commitments made by the licensee to be completed prior to restart of the unit. The unit is expected to be ready for restart on October 14, 1989.

Quad Cities Nuclear, Power Station On September 14, 1989, while Unit I was th cold shutdown, a generator field breaker was racked out with several out-of-service and hold tags on it.

Later, the same field breaker was found racked in, which was in violation of the out-of-service procedure. The individual responsible for this could not be positively identified, however, a contractor foreman was suspected.

This individual's employment was terminated. The breaker was disconnected prior to being racked back in so there was no immediate hazard involved.

Zion Nuclear Power Station On October 1,1989, at about 12:40 a.m., while performing a special test procedure which cycled a safety injection va've, the licensee inadvertently spilled about 650 gallons of reactor coolant from the refueling water storage tank into the containment drain sumps via the steam generator manways which were removed for eddy current testing. No personal contamination occurred in the event.

Zion Nuclear Power Station l

Mr. H. J. Miller and members of his staff met with Commonwealth Edison Company representatives in the Region III office on October 4,19*9.

Commonwealth Edison Company presented their analysis of the Zion Station requalification program effectiveness based on the results of the NRC requalification examinations administered the week of September 11, 1989.

Five of twelve operators taking the examination failed at least one portion of the examination and were removed from shift. The Zion recua11fication program was rated unsatisfactory. A Confirmatory Action Letter was issued on October 6,1989, identifying the corrective measures by Commonwealth Edison in the near term.
