U.S. Nuclear Regulatory Commission Public Meeting on November 18, 2019 SPENT FUEL CASK CERTIFICATE OF COMPLIANCE FORMAT AND CONTENT Background Information and Meeting Expectations Background (PRM-72-7 Petition and Post-Petition Activities)

  • NRC received NEI petition for rulemaking PRM-72-7 on October 3, 2012 (ADAMS Accession No. ML12299A380);
  • NRC published a notice of receipt and requested public comments on February 5, 2013 (78 FR 8050);
  • The agency received five comment letters all of which were in support of the petition (ML14134A072)
  • NRC published a notice announcing consideration of the petition in the rulemaking process for all six of the requested items, on July 18, 2014 (79 FR 41935):
  • During development of the Rulemaking Plan, the staff subsequently identified additional enhancements to clarify the regulations and improve Part 72 implementation efficiency.
  • Following the acceptance of PRM-72-7, NRC staff from NMSS/DFM and industry recognized the need to improve the licensing process for dry storage of spent fuel and collaborated on an initiative to conduct a pilot study to use a graded approach to develop criteria to help establish clear and specific requirements and amend the CoC format and content accordingly. The pilot study regarding the graded approach is now nearing completion.

Meeting Purpose and Expectations The purpose of this meeting is to: 1) discuss the issues and amendment requests contained in PRM-72-7 (Petition to Amend 10 CFR Part 72, "Licensing Requirements for the Independent Storage of Spent Nuclear Fuel, High-Level Radioactive Waste, and Reactor Related Greater-Than-Class C Waste); 2) ascertain participants current level of interest in the issues in PRM-72-7; and 3) discuss staff-initiated issues regarding Part 72; and 4) obtain input from the participants on rulemaking and non-rulemaking alternatives, such as regulatory guidance that would address both the petition issues and additional staff-identified changes in 10 CFR Part 72.
