PROPOSED liiPOSITION Or CIVIL PEKALTY - $25,000 This is to inform the Coassission that a Notice of Yiolation and Proposed imposition of Civil Penalty in the amount of $25,000 will t's issued on or 6 bout November 13, 1989 to On.sha Public Power District. This action is based on several incidents involving the failute to adequately protect Safeguards Information. The escalation and mitigation factors in the Enforcement Policy i
were considered and the base aucunt of the civil Mnalty was mitigated due to the licensee's identification and reporting of the viciation and because of the corrective actions taken. However, the civil pealty was escalated because of the multiple exuples of the this type of violation. Therefore.
on balance, the base nount of the civil p6nalty was mitigated by 50%.
It should be noted that the licensea has not been spcifically informed of the enforcecant action.
The schedule of issuance and notification is:
Mailing of Notice Novecher 13, 1989 Telephone Notification cf Licensee November 13, 1989 The State of Nebraska will be notifisc.
The licensee has thirty days f rom the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil pentity may be remittec, mitigated, or imposed by Order.
