.I This is to inform the Commission that the staff intendt to exercise broad i~
' discretion and not reopose a civil penalty for a Severity Level III violation 6t Fort Calhoun. Frior notice to the Commission is required before exercising
- this authority in accordance with Section V.G of the Enforcenwnt Policy. The
. violation involved inadequate ASME testing of the turbine-driven aux 111sry feedwater pump. This resulted in a cegraded pump performance condition going undetected ior an extended period of time. A pneumatic spe.ed control system deficiency rendered the-pump incapable of achieving the speed and discharge pressure necessary to meet the design assumptions of some accident conditions.
This deficiency was discovered by the licensee during the performance of a special test conducted in response to,:oncerns raised by NRC inspectors.

Application of the normal guidance in the Enforcement Policy is not warranted and a civil pehalty is not p(2) posed because (1) the licensee was responsive to regulatory concerns,once ro corrective actions were prompt and extensive, and (3) the licensee had previously developed, and was in the process of implenienting a Safety Enhancement Progtam (SEP), which was initiated as a result of belpg placed on the Problem Plant List. The SEP has httributes kna elenets of the type that the staff would have expected to identify this and similar problesis.
It should be noted that the licensee has not been specifically informed of the enforcement action.
