Dear Mr. Dircks:

On April 28, 1980, during resumed evidentiary hearings in the above captioned matter, NRC staff counsel distributed a document entitled " Affidavit of Donald J. Kasun" dated, April 24, 1980, which outlines the NRC staff's review of Revision 2 to the Spent Fuel Transportation Plan dated April 8,1980.

Therein at page 8 it is stated:

"The Licensee has committed to all the regulatory requirements with the following exceptions.

First, the Licensee has not com=itted to make the necessary two-hour call-ins.

Second, the Licensee has not identified the specific locations through which armed escorts will be used. Third, the Licensee has not committed to the use of CB radio equipment in the escort vehicles. Finally, the Licensee has not coc=itted to develop 1

instructions to meet Section 73.37(b)(3)."

This letter is to advise you that Duke Power Co=pany will submit a revision to the Spent Fuel Transportation Plan which will' incorporate the following provisions:

l 1.

Contact will be made with the Designated Co==unication Center (DCC) at least every two hours, utilizing the communications network described in the plan.

2.

Armed escorts will be provided through the urban areas of Greenville, South Carolina and Charlotte, North Carolina in accordance with NU?.EG-0561 as revised.

3.

The escort vehicles will be provided with C3 radio equipment.

Instructions for escorts -ill be developed in accordance with Section 73.37 (b) (3).

5.

Shipments will be planned so that scheduled intermediate stops are avoided to the extent prar.ticable.

With the inclusion of these provisious in the Spent Fuel Transportation Plan, the plan will meet the requirements of 10CFR 573.37.
