MOTION OF THE DEPARTMENT OF JUSTICE TO ESTABLISH A TRIAL DATE AND OTHER PROCEDURAL DATES The Department of Justice (" Department") hereby respect-fully requests that the Atomic Safety and Licersing Board

(" Licensing Board") establish a trial date and othcr procedural dates in order to facilitate final pre-trial preparation and determination of the issues in the above-captioned proceedings.

On April 10, 1980, the Licensing Board granted a limited 30-day extension of time pursuant to the April 2, 1980 Joint Motion of the Nuclear Regulatory Commission Staff, Texas Elec-tric Generation Company ("TUGCO"), Houston Lighting and Power Company ("HL&P"), City of Austin, City Public Service Board of San Antonio, South Texas Electric Cooperative, Medina Electric Cooperative, and Tex-La Electric Cooperative of Texas, Inc.,

requesting time to explore the possibility of settlement. All parties utilized that 30-day period, pursuant to the Licensing IJoard's Order, to explore settlement and filed reports of these

efforts on May 9, 1980. On May 13, 1980, the Licensing Board ,

issued an Order Extending Procedural Dates to Accomodate Settlement Negotiations and Notice.of Prehearing Conference.

In its May 1980 Order, however, the Licensing Board did not set a new trial date and procedural dates, as it did in its April 10, 1980 Order.

Since the filing of the Department's Settlement Status Report on May 9, 1980, the Department has continued to have telephone conferences with counsol for TUGCO and HL&P and has participated in a day-long meeting on May 14, 1980, in Washing-ton, D. C. in an attempt to reach a basis for a potential settlement of these proceedings. On May 19, 1980, however, the Department was informed by counsel for TUGCO that a potential.

settlement on the basis of the May 14,.1980, meeting was not presently possible. On May 20, 1980, the Department was also informed that HL&P's position is essentially the same as TUGCO on this issue. Therefore, based on these recent developments, the Department believes that g trial date'and other procedural dates should be established promptly in order to expedite final trial preparation in these proceedings and to enhance the settlement process.

These proceedings were initiated pursuant tx) the Attorney General's Advice-Letter on August ~1, 1978. Since then, the Li-censing Board has. closely supervised discovery,_other pretrial phases of this proceeding, and the exploration of settlement

should be sufficiently prepared at this point to commit to the commencement of trial within the time period set forth in the proposed schedule set forth below.
